1. Application of these Terms

These are the terms and conditions of the Caltex Rewards Programme ("Terms"). By participating in the Caltex Rewards Programme, you agree to be bound by these Terms and all terms incorporated by reference herein, without any limitation or qualification.
เอกสารฉบับนี้คือข้อกำหนดและเงื่อนไขของระบบสะสมคะแนนคาลเท็กซ์รีวอร์ด (“ข้อกำหนดฯ”) โดยท่านตกลงเข้าผูกพันตนตามข้อกำหนดฯ รวมถึงข้อกำหนดอื่น ๆ ที่ได้อ้างถึงในข้อกำหนดฯ โดยไม่มีข้อจำกัดและข้อสงวนสิทธิใด ๆ ณ เวลาที่ท่านเข้าร่วมระบบสะสมคะแนนคาลเท็กซ์รีวอร์ด

In these Terms, the following terms shall have the meanings as set forth below, save where the context otherwise requires:
ในข้อกำหนดฯ นี้ ให้คำและข้อความต่างๆ มีความหมายดังนี้ เว้นแต่จะได้กำหนดไว้เป็นอย่างอื่น
(a) "Account" means a user account on the Application, Company’s website or records at the payment terminals device at any of the Stations;
(ก) “บัญชี” หมายถึง บัญชีผู้ใช้บริการบนแอปพลิเคชัน เว็บไซต์ของบริษัท หรือรายการบันทึกต่าง ๆ ณ เครื่องชำระเงินประจำสถานีบริการน้ำมัน
(b) "Application" means the CaltexGO mobile application;
(ข) “แอปพลิเคชัน” หมายถึง แอปพลิเคชันคาลเท็กซ์โก (CaltexGO) บนอุปกรณ์เคลื่อนที่
(c) "Caltex Rewards Card" means the card which reflects a Member's membership in the Caltex Rewards Programme, which may either be a digital card issued on the Application and linked to your Account or a physical card (at the sole discretion of Company) or an Account on Company’s website or an Account applied at the point-of-sale or payment terminals at any of the Stations;
(ค) “บัตรสะสมคะแนนคาลเท็กซ์รีวอร์ด” หมายถึง บัตรซึ่งแสดงความเป็นสมาชิกของระบบสะสมคะแนนคาลเท็กซ์รีวอร์ด ไม่ว่าจะอยู่ในรูปแบบดิจิทัลบนแอปพลิเคชันและเชื่อมโยงไว้กับบัญชีของท่าน หรือบัตรแข็ง (ขึ้นอยู่กับดุลพินิจแต่เพียงผู้เดียวของบริษัท) หรือบัญชีบนเว็บไซต์ของบริษัท หรือบัญชีที่ใช้กับระบบขายหน้าร้านหรือระบบชำระเงินประจำสถานีบริการน้ำมัน
(d) "Caltex Rewards Points" means the loyalty points issued to Members through the Caltex Rewards Programme;
(ง) “คะแนนคาลเท็กซ์รีวอร์ด” หมายถึง คะแนนสะสมซึ่งออกให้แก่สมาชิกผ่านระบบสะสมคะแนนคาลเท็กซ์รีวอร์ด
(e) "Caltex Rewards Programme" means the loyalty rewards programme owned and managed by Company, the terms and conditions of which are set out in these Terms;
(จ) “ระบบสะสมคะแนนคาลเท็กซ์รีวอร์ด” หมายถึง ระบบสะสมคะแนนซึ่งเป็นเจ้าของและบริหารจัดการโดยบริษัท ซึ่งมีข้อกำหนดและเงื่อนไขตามที่ได้กำหนดไว้ในข้อกำหนดฯ นี้
(f) "Company" or "we" (including its variations "our" and "us") means Star Fuels Marketing Limited;
(ฉ) “บริษัท” หรือ “เรา” หมายถึง บริษัท สตาร์ ฟูเอลส์ มาร์เก็ตติ้ง จำกัด
(g) "Company Group" means collectively Company and its parent and other affiliated or related companies;
(ช) “บริษัทในกลุ่มของเรา” หมายถึง บริษัท และบริษัทแม่และบริษัทในเครือหรือบรรดาบริษัทที่เกี่ยวข้องอื่น ๆ ของบริษัท
(h) "Linked Sites" means the third-party websites that may be linked via the Application in connection with the Caltex Rewards Programme;
(ซ) “เว็บไซต์ที่ถูกเชื่อมโยง ” หมายถึง บรรดาเว็บไซต์ของบุคคลภายนอกที่อาจเชื่อมต่อกับแอปพลิเคชันเกี่ยวกับระบบสะสมคะแนนคาลเท็กซ์รีวอร์ด
(i) "Member" or "you" means a person who has been approved by Company to participate in the Caltex Rewards Programme;
(ฌ) “สมาชิก” หรือ “ท่าน” หมายถึง บุคคลที่ได้รับอนุมัติจากบริษัทให้เข้าร่วมระบบสะสมคะแนนคาลเท็กซ์รีวอร์ด
(j) “Partner Programme” means a loyalty programme managed by a third party that Company has partnered with as part of the Caltex Rewards Programme;
(ญ) “ระบบสะสมคะแนนของพันธมิตรทางธุรกิจ” หมายถึงระบบสะสมคะแนนซึ่งบริหารจัดการโดยบุคคลภายนอกที่เป็นพันธมิตรทางธุรกิจกับบริษัทภายใต้ระบบสะสมคะแนนคาลเท็กซ์รีวอร์ด
(k) "Station" means any participating Caltex service station situated in the Territory; and
(ฎ) “สถานีบริการน้ำมัน” หมายถึง สถานีบริการน้ำมันเชื้อเพลิงคาลเท็กซ์ที่อยู่ในพื้นที่ซึ่งเข้าร่วมระบบสะสมคะแนนคาลเท็กซ์รีวอร์ด
(l) "Territory" means Thailand.
(ฏ) “พื้นที่” หมายถึง ประเทศไทย

3.1 Introduction of Caltex Rewards Programme

With the aim of facilitating better connections with its customers, Company has implemented the Caltex Rewards Programme. The Caltex Rewards Card enables the Members to earn and redeem Caltex Rewards Points, subject to such terms and conditions as may be determined by Company from time to time and notified to its customers via Company’s rewards catalogue or other means

3.2 Existing Partner Loyalty Programme

Prior to the introduction of the Caltex Rewards Programme, some Members may have had another reward card for fuel purchases at the Stations run by our third-party service provider (“Prior Rewards Card”) and accumulated points (“Prior Rewards Programme”). Notwithstanding the introduction of the Caltex Rewards Programme, the points accumulated through the Prior Rewards Card will continue to be valid and can be redeemed through the Prior Rewards Programme subject to its terms and conditions as notified by Company and the third-party service provider from time to time.
ก่อนการเริ่มใช้ระบบสะสมคะแนนคาลเท็กซ์รีวอร์ด สมาชิกบางท่านอาจได้เข้าร่วมโครงการบัตรสะสมรางวัลสำหรับการเติมน้ำมันเชื้อเพลิง ณ สถานีบริการน้ำมันซึ่งบริการจัดการโดยผู้ให้บริการของเราซึ่งเป็นบุคคลภายนอก (“บัตรสะสมรางวัลก่อนหน้า”) และได้สะสมคะแนนไว้ (“ระบบสะสมคะแนนก่อนหน้า”) ทั้งนี้ แม้จะมีการเริ่มใช้ระบบสะสมคะแนนคาลเท็กซ์รีวอร์ดแล้วก็ตาม บรรดาคะแนนซึ่งได้สะสมผ่านบัตรสะสมรางวัลก่อนหน้าจะยังคงมีผลและสามาถใช้แลกรางวัลได้ผ่านระบบสะสมคะแนนก่อนหน้าต่อไป ตามข้อกำหนดและเงื่อนไขที่บริษัทและผู้ให้บริการซึ่งเป็นบุคคลภายนอกจะได้แจ้งให้ทราบเป็นครั้งคราว
4. Eligibility & Registration

4.1 Eligibility Criteria

Any individual person aged 18 or above may apply to be a Member. However, Company reserves the right to determine in its sole discretion the eligibility of any individual as a Member and to reject any application for the Caltex Rewards Programme without having to provide any reason whatsoever to the applicant.
บุคคลใดๆ ที่มีอายุตั้งแต่ 18 ปี ขึ้นไปมีสิทธิ์สมัครเป็นสมาชิก อย่างไรก็ตาม บริษัทขอสงวนสิทธิ์ในการใช้โดยดุลพินิจแต่เพียงผู้เดียวของบริษัทในการพิจารณาคุณสมบัติของบุคคลที่สมัครเป็นสมาชิกและปฏิเสธคำขอสมัครสมาชิกของระบบสะสมคะแนนคาลเท็กซ์รีวอร์ด โดยไม่จำเป็นต้องชี้แจงเหตุผลใด ๆ แก่ผู้สมัคร
Member aged 20 or above may opt-in to marketing communications and advertisements (“Marketing Communications”), including promotions and benefits of Caltex Rewards Programme. However, Company reserves the right to determine in its sole discretion the eligibility of Member that has opted-in the Marketing Communications and to reject any opt-in application for such Marketing Communications without having to provide any reason whatsoever to Member.
สมาชิกที่มีอายุตั้งแต่ 20 ปีขึ้นไปมีสิทธิ์เลือกรับข่าวสารประชาสัมพันธ์ทางการตลาดและโฆษณา (“ข่าวสารประชาสัมพันธ์ทางการตลาด”) อันรวมถึงสิทธิประโยชน์และโปรโมชั่นต่างๆ ของระบบสะสมคะแนนคาลเท็กซ์รีวอร์ด อย่างไรก็ตาม บริษัทขอสงวนสิทธิ์ในการใช้ดุลพินิจแต่เพียงผู้เดียวของบริษัทในการพิจารณาคุณสมบัติของสมาชิกที่เลือกรับข่าวสารประชาสัมพันธ์ทางการตลาดและปฏิเสธคำขอเลือกรับข่าวสารประชาสัมพันธ์ทางการตลาด โดยไม่จำเป็นต้องชี้แจงเหตุผลใด ๆ แก่สมาชิก
4.2 Registration Process

(a) In order to participate in the Caltex Rewards Programme, you will need to submit an application through Company's website (here), via the Application, or at the point-of-sale or payment terminals device at any of the Stations as instructed by Company from time to time. No application fee or membership fee is payable. Unless you have successfully completed the application process, you will not be able to earn or redeem any Caltex Rewards Points under the Caltex Rewards Programme.
(ก) ในการเข้าร่วมระบบสะสมคะแนนคาลเท็กซ์รีวอร์ด ท่านต้องดำเนินการสมัครสมาชิกบนเว็บไซต์ของบริษัท (ที่นี่) ผ่านทางแอปพลิเคชัน หรือระบบขายหน้าร้านหรือเครื่องชำระเงินประจำสถานีบริการน้ำมันตามที่บริษัทกำหนดไว้เป็นครั้งคราว การสมัครสมาชิกไม่มีค่าใช้จ่ายหรือค่าธรรมเนียมสมาชิกใด ๆ ท่านจะยังไม่สามารถสะสมหรือใช้คะแนนคาลเท็กซ์รีวอร์ดผ่านระบบสะสมคะแนนคาลเท็กซ์รีวอร์ดได้จนกว่าท่านจะดำเนินการสมัครสมาชิกเสร็จสมบูรณ์
(b) For the Account applied at the payment terminals device at any of the Stations, you can still earn normal point scheme as announced by Company from time to time and redeem the basic rate of fuel discount at the Stations; however, you will not be eligible to earn the extra point or special point and you will not be eligible to redeem other rewards apart from basic rate of fuel discount at the Stations, unless you complete the registration in Company's website (here) or in Application,
(ข) สำหรับบัญชีที่สมัครผ่านเครื่องชำระเงินประจำสถานีบริการน้ำมัน ท่านจะยังคงสามารถสะสมคะแนนรูปแบบปกติได้ตามที่บริษัทได้ประกาศเป็นครั้งคราว และสามารถแลกรางวัลส่วนลดการเติมน้ำมันเชื้อเพลิง ณ สถานีบริการน้ำมันได้ตามอัตราขั้นพื้นฐาน แต่ท่านจะไม่ได้รับสิทธิ์สะสมคะแนนเพิ่มหรือคะแนนพิเศษ และไม่ได้รับสิทธิ์ในการแลกรางวัลอื่น ๆ นอกเหนือจากรางวัลส่วนลดการเติมน้ำมันเชื้อเพลิง ณ สถานีบริการน้ำมันตามอัตราขั้นพื้นฐาน เว้นแต่ท่านจะได้ลงทะเบียนบนเว็บไซต์ของบริษัท (ที่นี่) หรือบนแอฟพลิเคชันจนเสร็จสมบูรณ์
(c) All mandatory fields specified in the application for the Caltex Rewards Programme (including your full name, birth month, birth year, a valid mobile number, and a valid email address) must be completed for the application to be processed. Company may contact you through the email address, mobile phone number, and/or in CaltexGO Application you have provided regarding the Caltex Rewards Programme, and for other purposes as may be mentioned in these Terms and the Privacy Statement.
(ค) ท่านจะต้องกรอกข้อมูลในส่วนที่ระบุว่าจำเป็นในการสมัครสมาชิกระบบสะสมคะแนนคาลเท็กซ์รีวอร์ด (ซึ่งรวมถึงชื่อเต็ม เดือนเกิด ปีเกิด หมายเลขโทรศัพท์เคลื่อนที่ที่ใช้งานได้ และที่อยู่อีเมลที่ใช้งานได้) ให้ครบถ้วนเพื่อให้สามารถดำเนินการสมัครสมาชิกได้ ทั้งนี้ บริษัทอาจติดต่อท่านเกี่ยวกับระบบสะสมคะแนนคาลเท็กซ์รีวอร์ดหรือเพื่อวัตถุประสงค์อื่น ๆ ที่อาจระบุไว้ในข้อกำหนดฯ นี้และนโยบายความเป็นส่วนตัว ผ่านที่อยู่อีเมล หมายเลขโทรศัพท์เคลื่อนที่ และ/หรือผ่านแอปพลิเคชันคาลเท็กซ์โกตามข้อมูลที่ท่านได้ให้ไว้
5. Membership & Caltex Rewards Cards

5.1 Approval for Membership
5.1 การอนุมัติสมาชิกภาพ
(a) Upon approval of your application by Company, Company may elect in its sole discretion to issue a physical or digital Caltex Rewards Card or no Card but in all cases, your membership in the Caltex Rewards Programme will be reflected in your Account. Upon your membership being reflected in your Account, you may commence participating in the Caltex Rewards Programme through qualifying purchases for the purposes of accumulating the Caltex Rewards Points and redeeming them for rewards, subject always to the terms and conditions prescribed by Company in its discretion from time to time.
(ก) เมื่อการสมัครสมาชิกของท่านได้รับการอนุมัติ บริษัทอาจใช้ดุลพินิจแต่เพียงผู้เดียวในการออกบัตรสะสมคะแนนคาลเท็กซ์รีวอร์ดในรูปแบบบัตรแข็งหรือรูปแบบดิจิทัลหรือไม่มีการออกบัตรใด ๆ ทั้งนี้ ไม่ว่าในกรณีใดก็ตาม สมาชิกภาพของระบบสะสมคะแนนคาลเท็กซ์รีวอร์ดของท่านจะปรากฏอยู่ในบัญชีของท่าน เมื่อสมาชิกภาพของท่านปรากฏอยู่ในบัญชีของท่านแล้ว ท่านสามารถเริ่มการใช้งานระบบสะสมคะแนนคาลเท็กซ์รีวอร์ดผ่านการซื้อสินค้าที่กำหนดไว้เพื่อการสะสมคะแนนคาลเท็กซ์รีวอร์ดและดำเนินการแลกรับรางวัลได้ ตามข้อกำหนดและเงื่อนไขที่บริษัทใช้ดุลพินิจกำหนดไว้เป็นครั้งคราว
(b) You acknowledge that your membership in the Caltex Rewards Programme is personal to you, and shall not be transferred to any other person.
(ข) ท่านรับทราบว่าสมาชิกภาพของท่านในระบบสะสมคะแนนคาลเท็กซ์รีวอร์ดเป็นเรื่องจำเพาะส่วนตัวของท่าน และไม่สามารถโอนให้แก่บุคคลใดได้
(c) Where a Caltex Rewards Card has been issued, the Member must take proper care of the Caltex Rewards Card. If the Caltex Rewards Card is loss of control/access or device or Card is stolen, lost, damaged or defaced, Company may decide in its sole discretion (but is not obliged) to cancel the Caltex Rewards Card and issue a replacement Caltex Rewards Card. If Company elects to issue a replacement Caltex Rewards Card, Company reserves the right to charge a fee for the replacement Caltex Rewards Card.
(ค) ในกรณีที่มีการออกบัตรสะสมคะแนนคาลเท็กซ์รีวอร์ด สมาชิกต้องดูแลรักษาบัตรสะสมคะแนนคาลเท็กซ์รีวอร์ดอย่างเหมาะสม หากบัตรสะสมคะแนนคาลเท็กซ์รีวอร์ดไม่อยู่ในความควมคุมหรือการเข้าถึงของท่าน หรือหากอุปกรณ์หรือตัวบัตรถูกขโมย สูญหาย เสียหาย หรือชำรุด บริษัทอาจ (แต่ไม่มีหน้าที่ต้อง) ใช้ดุลพินิจแต่เพียงผู้เดียวในการพิจารณายกเลิกบัตรสะสมคะแนนคาลเท็กซ์รีวอร์ดและออกบัตรใหม่เพื่อทดแทนบัตรสะสมคะแนนคาลเท็กซ์รีวอร์ดดังกล่าว ในกรณีที่บริษัทตกลงที่จะดำเนินการออกบัตรใหม่เพื่อทดแทนบัตรสะสมคะแนนคาลเท็กซ์รีวอร์ด บริษัทขอสงวนสิทธิ์ในการคิดค่าธรรมเนียมสำหรับการออกบัตรใหม่ดังกล่าว
(d) Where a Caltex Rewards Card has been issued, a Member may report any loss or theft of the Caltex Rewards Card either through Company's website (here) or its hotline at 02 081 4123 (office hour every day from 8.00 am to 8.00 pm. or email to thcsc@sprc.co.th), or via the Application. Company shall not be responsible for any transactions effected prior to the receipt by Company of notice of such loss or theft and Company reserves the right to debit your Account for any and all redemptions that are affected prior to notification to Company of such loss or theft.
(ง) ในกรณีที่มีการออกบัตรสะสมคะแนนคาลเท็กซ์รีวอร์ด สมาชิกอาจดำเนินการแจ้งเหตุบัตรสะสมคะแนนคาลเท็กซ์รีวอร์ดสูญหายหรือถูกขโมยผ่านเว็บไซต์ของบริษัท (ที่นี่) หรือสายด่วนที่หมายเลข 02 081 4123 (ในเวลาทำการตั้งแต่เวลา 8.00 – 20.00 นาฬิกา ของทุกวัน หรือทางอีเมลที่ thcsc@sprc.co.th) หรือผ่านทางแอปพลิเคชัน ทั้งนี้ บริษัทจะไม่รับผิดชอบใด ๆ ต่อการดำเนินธุรกรรมใด ๆ ที่เกิดขึ้นก่อนเวลาที่บริษัทได้รับแจ้งเหตุบัตรสะสมคะแนนคาลเท็กซ์รีวอร์ดสูญหายหรือถูกขโมย และบริษัทขอสงวนสิทธิ์ในการหักจำนวนคะแนนสะสมจากบัญชีของท่านสำหรับการแลกคะแนนรางวัลที่เกิดขึ้นก่อนเวลาที่บริษัทได้รับแจ้งเหตุบัตรสะสมคะแนนคาลเท็กซ์รีวอร์ดสูญหายหรือถูกขโมยดังกล่าว
5.2 Representations and Warranties by Member
5.2 คำรับรองและคำยืนยันของสมาชิก
You represent and warrant that all information provided in connection with the registration and participation in the Caltex Rewards Programme is true, accurate and not misleading, and will remain true, accurate and not misleading for as long as you remain as a Member. In the event of any changes to the details or particulars from time to time, you shall update Company either through Company's website (here) or its hotline at 02 081 4123 (office hour every day from 8.00 am to 8.00 pm. or email to thcsc@sprc.co.th), or via the Application.
ท่านรับรองและยืนยันว่าข้อมูลทั้งหมดที่ท่านได้ให้ไว้เกี่ยวกับการลงทะเบียนและการเข้าร่วมระบบสะสมคะแนนคาลเท็กซ์รีวอร์ดเป็นความจริง ถูกต้อง และไม่ก่อให้เกิดความเข้าใจผิด และจะยังคงความจริง ความถูกต้อง และความไม่ก่อให้เกิดความเข้าใจผิดอยู่ตราบใดที่ท่านยังคงสถานะความเป็นสมาชิก ในกรณีที่มีการเปลี่ยนแปลงรายละเอียดหรือข้อมูลใดเป็นครั้งคราว ท่านจะปรับปรุงรายละเอียดหรือข้อมูลดังกล่าวผ่านเว็บไซต์ของบริษัท (ที่นี่) หรือสายด่วนที่หมายเลข 02 081 4123 (ในเวลาทำการตั้งแต่เวลา 8.00 – 20.00 นาฬิกา ของทุกวัน หรือทางอีเมลที่ thcsc@sprc.co.th) หรือผ่านทางแอปพลิเคชัน
5.3 Rights of Company
5.3 สิทธิของบริษัท
Company may at any time, in its sole discretion, with or without prior notice to the Members, do any or all of the following:
บริษัทอาจใช้ดุลพินิจแต่เพียงผู้เดียวในการดำเนินการใดๆ ดังต่อไปนี้เป็นครั้งคราว ไม่ว่าจะแจ้งให้สมาชิกทราบล่วงหน้าหรือไม่ก็ตาม
(a) suspend or terminate any Caltex Rewards Card or any membership in the Caltex Rewards Programme, which may result in the forfeiture of the Caltex Rewards Points associated with such Caltex Rewards Card or membership in the Caltex Rewards Programme, without any compensation to the Member;
(ก) ระงับหรือยกเลิกบัตรสะสมคะแนนคาลเท็กซ์รีวอร์ดหรือสมาชิกภาพในระบบสะสมคะแนนคาลเท็กซ์รีวอร์ด ซึ่งอาจส่งผลให้มีการเรียกคืนคะแนนคาลเท็กซ์รีวอร์ดจากบัตรสะสมคะแนนคาลเท็กซ์รีวอร์ดหรือสมาชิกภาพในระบบสะสมคะแนนคาลเท็กซ์รีวอร์ดดังกล่าว โดยไม่ต้องชดใช้ค่าสินไหมทดแทนใด ๆ แก่สมาชิก
(b) refuse to re-issue, renew or replace the Caltex Rewards Card, or refuse to renew the membership in the Caltex Rewards Programme;

(c) terminate an existing Caltex Rewards Card and assign a new Caltex Rewards Card with a new card number to the Member; or
(ค) ยกเลิกบัตรสะสมคะแนนคาลเท็กซ์รีวอร์ดใด ๆ ที่มีอยู่ในปัจจุบัน และโอนไปยังบัตรสะสมคะแนนคาลเท็กซ์รีวอร์ดบัตรใหม่ของสมาชิกพร้อมหมายเลขบัตรใหม่ หรือ
(d) introduce, amend, restrict, suspend, terminate or make any changes to any or all of the benefits, services, facilities and privileges in respect of or in connection with the Caltex Rewards Cards and/or the Caltex Rewards Programme.

6. Accumulation and Validity of Caltex Rewards Points

6.1 Methods to Earn Caltex Rewards Points

A Member can earn the Caltex Rewards Points via any of the following methods:
(a) purchase of fuel at any Station;
(b) purchase of qualifying goods and services as prescribed by Company from time to time and listed on Company's website (here) and the Application; or
(c) such other method/special campaign as Company may notify from time to time,
subject to such terms and conditions (including but not limited to minimum spend conditions and verification requirements) as may be determined by Company from time to time. Additional Caltex Rewards Points may be issued by Company in its sole discretion during special promotions.

6.2 Conditions to Earn Caltex Rewards Points

(a) In addition to the above, Company shall record and credit the Caltex Rewards Points only at the point of sale, subject to Company's verification of the validity of your membership in the Caltex Rewards Programme. No Caltex Rewards Points will be awarded for any previous or backdated receipts. A Member shall not earn Caltex Rewards Points from the payment terminals device at any of the Stations more than 200 (two hundred) liters per transaction and shall be limited 2 (two) transactions within a day, provided that a Member shall not earn Caltex Rewards Points more than 1,000 (one thousand) liters per month.

(b) In the event that any of the conditions to earn Caltex Rewards Points is not met, Company may, in its sole discretion, do any of the following:
(i) delay the recording and crediting of such Caltex Rewards Points in the Member’s Account until all the relevant conditions are met;
(ii) refuse to record and credit such Caltex Rewards Points in the Member’s Account; or
(iii) if the Caltex Rewards Points have already been recorded and credited into the Member’s Account, cancel and deduct such Caltex Rewards Points from such Account.
(ข) หากเกิดกรณีที่เงื่อนไขการสะสมคะแนนคาลเท็กซ์รีวอร์ดใด ๆ ไม่ครบถ้วน บริษัทอาจใช้ดุลพินิจแต่เพียงผู้เดียวในการดำเนินการดังต่อไปนี้
(1) ชะลอการบันทึกและมอบคะแนนคาลเท็กซ์รีวอร์ดดังกล่าวในบัญชีของสมาชิกจนกว่าเงื่อนไขจะสำเร็จครบถ้วน

(c) Any decision made by Company under this paragraph 6.2 shall be final and binding.

6.3 Accumulation of Caltex Rewards Points
You can check your accumulated Caltex Rewards Points and your transaction history by logging into your Account on the Application or Company’s website. For the avoidance of doubt, Company will not be providing periodic updates or physical statement to you regarding your accumulated Caltex Rewards Points.
6.3 การสะสมคะแนนคาลเท็กซ์รีวอร์ด
ท่านสามารถตรวจสอบคะแนนคาลเท็กซ์รีวอร์ดสะสมและประวัติธุรกรรมผ่านการลงชื่อเข้าบัญชีของท่านบนแอปพลิเคชันหรือเว็บไซต์ของบริษัท ทั้งนี้ บริษัทจะไม่แสดงรายการข้อมูลเป็นช่วงระยะเวลาหรือออกเอกสารข้อมูลใด ๆ เกี่ยวกับการสะสมคะแนนคาลเท็กซ์รีวอร์ดของท่าน
6.4 Validity

(a) The Caltex Rewards Points earned in a calendar year will expire on 31 December of the following two calendar year. (As an example, Caltex Reward Points earned in 2022 will expire on 31 December 2024.) Company reserves the right to amend the validity period of the Caltex Rewards Points from time to time without any prior notice to the Members, and such amendment shall take place from the date on which it is published on Company's website (here) or on the Application (whichever is earlier). Expired Caltex Rewards Points will be automatically forfeited at the absolute discretion of Company without compensation to the Member.

(b) The Caltex Rewards Points are automatically void upon termination of the Caltex Rewards Programme, or when you cease to be a Member. Members shall not be entitled to any compensation in respect of any cancellation of Caltex Rewards Points by Company pursuant to these Terms.

6.5 Non-transferable
The Caltex Rewards Points accumulated in your Account cannot be transferred or assigned to any other Member.

7. Redemption of Caltex Rewards Points

7.1 Conditions to Redemption

(a) A Member may only redeem the Caltex Rewards Points after he/she has accumulated sufficient points in his/her Account and is eligible for such redemption, subject to fulfilling any terms and conditions as may be imposed by Company from time to time. The Caltex Rewards Points utilised for redemption shall be on a first-in-first-out basis.
(ก) สมาชิกจะสามารถแลกคะแนนคาลเท็กซ์รีวอร์ดได้ก็เมื่อได้สะสมคะแนนในบัญชีจนเพียงพอและเข้าเกณฑ์สำหรับการแลกคะแนน ตามข้อกำหนดและเงื่อนไขที่บริษัทอาจกำหนดใช้เป็นครั้งคราว คะแนนคาลเท็กซ์รีวอร์ดจะถูกใช้แลกรางวัลในรูปแบบการเข้าก่อนออกก่อน (first-in-first-out)
(b) In order to redeem the Caltex Rewards Points for fuel or any product at the Station, a Member must present (i) his membership in the Caltex Rewards Programme and (ii) PIN set up in Application or Company’s website and/or one-time-password send to Member’s mobile phone or email (“OTP”) at the point of purchase. A Member who fails to present or validate his membership at the point of such redemption will not be permitted to redeem the Caltex Rewards Points.

(c) Company reserves the right to adjust (whether by way of an increase or a decrease) the Caltex Rewards Points required for redemption without any prior notice to the Members. All redemptions are subject to availability and change, and Company reserves the right to cancel, amend, substitute or remove any rewards or the terms of redemption without any prior notice to the Members.

(d) Notwithstanding anything contained herein, there is no cash value attributed to the Caltex Rewards Points.

The Members may use their Caltex Rewards Points to offset payments for fuel purchases at any Station, whether partially or fully. The redemption of the Caltex Rewards Points for offsetting payments is subject to the following:

(a) unless permitted in these Terms, any deduction of the Caltex Rewards Points from the Account shall not be refunded to the Member for any reason whatsoever; and
(ก) จะไม่มีการคืนคะแนนคาลเท็กซ์รีวอร์ดที่ได้หักจากบัญชีแล้วแก่สมาชิก ไม่ว่าด้วยเหตุผลใดก็ตาม เว้นแต่กรณีที่กำหนดไว้ว่าสามารถทำได้ตามข้อกำหนดฯ นี้
(b) in the event that payment still needs to be made by the Member after offsetting the purchase price against the redeemed Caltex Rewards Points, the Member shall make the necessary payment and shall not dispute the amount payable.

7.3 Redemption

Subject to the relevant terms and conditions prescribed by Company from time to time, the Members may use their Caltex Rewards Points to:

(a) convert them into such vouchers as notified by Company from time to time;

(b) redeem rewards from the rewards catalogue of the Caltex Rewards Programme, which is published on Company's website (here) and/or the Application, provided always that the use of any rewards is subject to the terms and conditions imposed by the relevant merchant offering the reward, any disputes concerning any rewards shall be settled between the Member and the relevant merchant offering the reward, and Company shall not in any way be involved in such claims and/or disputes (save where Company itself is the merchant supplying the reward);
(ข) แลกรางวัลจากรายการรางวัลของระบบสะสมคะแนนคาลเท็กซ์รีวอร์ดที่ได้เผยแพร่บนเว็บไซต์ของบริษัท (ที่นี่) และ/หรือบนแอปพลิเคชัน ทั้งนี้ การใช้รางวัลจะขึ้นอยู่กับข้อกำหนดและเงื่อนไขที่ร้านค้าที่ออกรางวัลดังกล่าวเป็นผู้กำหนด ข้อพิพาทใด ๆ เกี่ยวกับรางวัลต้องดำเนินการแก้ไขยุติระหว่างสมาชิกและร้านค้าที่ออกรางวัลดังกล่าว โดยบริษัทจะไม่มีส่วนยุ่งเกี่ยวใด ๆ กับข้อเรียกร้องและ/หรือข้อพิพาทดังกล่าว (ยกเว้นในกรณีที่บริษัทเป็นร้านค้าที่ออกรางวัลดังกล่าว)
(c) take part in or contribute to any sustainability initiatives, activities or events which are initiated or organised by the Company Group (either on its own or with third parties); and

(d) take part in or contribute to any initiative or programme initiated or organised by the Company Group (either on its own or with third parties), as notified from time to time by way of a publication on Company's website (here) and/or the Application.

7.4 Conversion of Loyalty Points for points in Partner Programmes

Where Caltex Rewards introduces a programme where Caltex Rewards Points qualify for conversion to loyalty points in our Partner Programmes (or vice versa), the following requirements will apply:

(a) the Member must also be a member of the Partner Programme,;

(b) the conversion rate is to be determined by mutual agreement between Company and the relevant Partner from time to time;

(c) the Member must have the requisite number of Caltex Rewards Points or the loyalty points in the Partner Programme (as the case may be) to perform the intended conversion transaction, throughout the entire conversion process until completion, failing which Company or the Partner (as the case may be) may decline to proceed with the conversion;
(ค) สมาชิกจะต้องมีจำนวนคะแนนคาลเท็กซ์รีวอร์ดหรือคะแนนในระบบสะสมคะแนนของพันธมิตรทางธุรกิจ (แล้วแต่กรณี) ครบตามเงื่อนไขเพื่อดำเนินการแลกเปลี่ยนคะแนนตลอดระยะเวลาของขั้นตอนการแลกเปลี่ยนคะแนนจนกว่าการแลกเปลี่ยนจะดำเนินการสำเร็จเสร็จสิ้น ซึ่งบริษัทหรือพันธมิตรทางธุรกิจ (แล้วแต่กรณี) อาจปฏิเสธการแลกเปลี่ยนคะแนนหากมีการปฏิบัติผิดเงื่อนไขดังกล่าว
(d) in the event of a mistake or error in the number of Caltex Rewards Points to be deducted for the conversion, Company reserves the right to, in its sole discretion, cancel the conversion request or process the conversion and deduct the correct number of Caltex Rewards Points in respect of such conversion transaction;
(ง) ในกรณีที่เกิดเหตุผิดพลาดหรือข้อขัดข้องเกี่ยวกับจำนวนคะแนนคาลเท็กซ์รีวอร์ดที่จะถูกหักออกเพื่อการแลกเปลี่ยนคะแนน บริษัทขอสงวนสิทธิ์ในการใช้ดุลพินิจแต่เพียงผู้เดียวในการยกเลิกคำขอแลกเปลี่ยนคะแนนหรือขั้นตอนการแลกเปลี่ยนคะแนน และหักจำนวนคะแนนคาลเท็กซ์รีวอร์ดที่ถูกต้องสำหรับการแลกเปลี่ยนคะแนนดังกล่าว
(e) all conversion requests received by Company are final and cannot be cancelled by the Member; and

(f) all successful conversion transactions are final and non-cancellable, and in no event shall Company be responsible for any error, delay or failure of the Partner to send its confirmation of the successful conversion request on the Partner Programme or to issue the correct number of loyalty points pursuant to the conversion transaction.

Where Caltex Rewards introduces a programme where Members who are also members of certain Partner Programme have an option of choosing whether to earn and redeem their loyalty points for the qualifying purchases through the Caltex Rewards Programme or through the Partner’s Program,
ในกรณีที่มีการนำเสนอรายการที่สมาชิกซึ่งเป็นสมาชิกของระบบสะสมคะแนนของพันธมิตรทางธุรกิจสามารถเลือกที่จะสะสมและแลกคะแนนสะสมของสมาชิกจากการซื้อสินค้าที่เข้าร่วมโครงการผ่านระบบสะสมคะแนนคาลเท็กซ์รีวอร์ดหรือระบบสะสมคะแนนของพันธมิตรทางธุรกิจ
(a) if the Member chooses to earn and redeem their loyalty points through the Caltex Rewards Programme, these Terms will be applicable; and
(ก) ถ้าสมาชิกเลือกที่จะสะสมและแลกคะแนนสะสมของสมาชิกผ่านระบบสะสมคะแนนคาลเท็กซ์รีวอร์ด ให้ข้อกำหนดฯ นี้มีผลใช้บังคับ และ
(b) if the Member chooses to earn and redeem their loyalty points through the Partner’s Programme, the relevant terms and conditions of the Partner Programme will be applicable.
(ข) ถ้าสมาชิกเลือกที่จะสะสมและแลกคะแนนสะสมของสมาชิกผ่านระบบสะสมคะแนนของพันธมิตรทางธุรกิจ ให้ข้อกำหนดและเงื่อนไขของระบบสะสมคะแนนของพันธมิตรทางธุรกิจมีผลใช้บังคับ
8. Account

8.1 Changes to the Account
8.1 การแก้ไขเปลี่ยนแปลงบัญชี
Notwithstanding any other provisions in these Terms, Company reserves the right to make any changes to the Member’s Account (including but not limited to crediting or deducting Caltex Rewards Points from the Account, or suspending or terminating the Account) and/or disqualify the Member from participating in any contest, lucky draw, program, activity or event organised by Company (whether solely or jointly with any other partners or collaborators) without prior notice to the Member, upon the occurrence of any of the following circumstances:
ไม่ว่าจะมีการกำหนดไว้เป็นอย่างไรในข้อกำหนดฯ นี้ บริษัทขอสงวนสิทธิ์ในการแก้ไขเปลี่ยนแปลงบัญชีของสมาชิก (ซึ่งรวมถึงแต่ไม่จำกัดเฉพาะการเพิ่มหรือหักคะแนนคาลเท็กซ์รีวอร์ดจากบัญชี หรือระงับหรือเพิกถอนบัญชี) และ/หรือตัดสิทธิ์สมาชิกจากการเข้าร่วมรายการแข่งขัน การจับรางวัล โครงการ กิจกรรม หรืองานใด ๆ ที่จัดขึ้นโดยบริษัท (ไม่ว่าโดยบริษัทเองหรือร่วมกับพันธมิตรทางธุรกิจหรือผู้จัดอื่น ๆ) โดยไม่จำเป็นต้องแจ้งให้สมาชิกทราบล่วงหน้า หากเกิดเหตุการณ์ใดดังต่อไปนี้
(a) wrongful crediting or deduction of the Caltex Rewards Points arising from:
(i) system glitches, malfunction, failure or disruption with respect to the Account and/or the Application;
(ii) human error;
(iii) dishonest or fraudulent transactions, acts or omissions conducted by the Member or with respect to the Account; or
(iv) operational mistakes or changes;
(b) inaccurate, false, misleading or illegible information supplied by the Member; or
(c) changes in the terms and conditions of such contest, lucky draw, programme, activity or event.
(ก) การเพิ่มหรือหักคะแนนคาลเท็กซ์รีวอร์ดโดยไม่ชอบ ซึ่งเกิดจาก
(1) ความผิดพลาด การทำงานที่ผิดปรกติ ความบกพร่อง หรือการหยุดชะงักของบัญชีและ/หรือแอปพลิเคชัน
(2) ความผิดพลาดที่เกิดจากคน
(3) ธุรกรรม การกระทำ หรือการงดเว้นการกระทำที่เกิดจากเหตุทุจริตหรือฉ้อโกงของสมาชิกหรือที่เกี่ยวกับบัญชี
(4) การเปลี่ยนแปลงหรือความผิดพลาดในการดำเนินงาน
(ข) ข้อมูลที่ได้รับจากสมาชิกไม่ถูกต้อง เป็นเท็จ ทำให้เกิดความเข้าใจผิด หรือไม่ชอบด้วยกฎหมาย หรือ
(ค) การเปลี่ยนแปลงข้อกำหนดและเงื่อนไขของรายการแข่งขัน การจับรางวัล โครงการ กิจกรรม หรืองานดังกล่าว
8.2 Representations and Warranties by Member
8.2 คำรับรองและคำยืนยันของสมาชิก
You represent and warrant that:
(a) you will not create more than one Account for the Caltex Rewards Programme;
(b) you will not share your password or allow any other person to access your Account, or otherwise do anything that may or will violate the security of your Account;
(c) you will keep all information provided by you through the Account up to date and accurate;
(d) you will not transfer your Account to any other person without prior permission from Company; and
(e) you are responsible for the use of your Account and all activities that are carried out through the Account, whether authorised or unauthorised and must immediately notify Company if you become aware of any unauthorised use of or access to your Account.
ท่านรับรองและยืนยันว่า
(ก) ท่านจะไม่สร้างบัญชีเกินกว่าหนึ่งบัญชีสำหรับระบบสะสมคะแนนคาลเท็กซ์รีวอร์ด
(ข) ท่านจะไม่มอบรหัสการใช้งานบัญชีหรือยินยอมให้บุคคลอื่นใช้งานบัญชีหรือดำเนินการใด ๆ ที่อาจหรือจะเป็นการละเมิดความปลอดภัยของบัญชีของท่าน
(ค) ท่านจะปรับปรุงบรรดาข้อมูลที่ท่านได้ให้ไว้สำหรับบัญชีให้เป็นปัจจุบันและถูกต้อง
(ง) ท่านจะไม่โอนบัญชีให้กับบุคคลอื่นใดโดยไม่รับอนุญาตจากบริษัท
(จ) ท่านตกลงรับผิดชอบการใช้งานบัญชีของท่านและการดำเนินการใด ๆ ผ่านบัญชีดังกล่าว ไม่ว่าจะได้รับอนุญาตจากท่านหรือไม่ได้ตาม และท่านจะแจ้งให้บริษัททราบทันทีหากทราบถึงเหตุการใช้หรือการเข้าถึงบัญชีของท่านโดยไม่ได้รับอนุญาตจากท่าน
9. Termination

9.1 Termination by Company
9.1 การเลิกสัญญาโดยบริษัท
(a) Company may in its sole discretion, with reasonable prior notice to the Members, suspend or terminate the Caltex Rewards Programme. The Members shall not be entitled to any compensation for any such suspension or termination.
(ก) บริษัทอาจใช้ดุลพินิจแต่เพียงผู้เดียวในการระงับหรือยกเลิกระบบสะสมคะแนนคาลเท็กซ์รีวอร์ด โดยแจ้งให้สมาชิกทราบล่วงหน้าตามสมควร โดยสมาชิกไม่มีสิทธิ์ได้รับค่าสินไหมทดแทนใด ๆ จากการระงับหรือยกเลิกดังกล่าว
(b) Company may terminate or suspend the Member's Account and membership in the Caltex Rewards Programme with immediate effect if any one or more of the following shall occur:
(i) the Member no longer holds a valid Account or Caltex Rewards Card (as the case may be);
(ii) the Member's Account does not have any activity for a continuous period of 36 months. In this event, Company has its sole right (but is not obliged) to reactivate the Account if the Member can provide validation of his mobile phone number and email address given for the Account with PIN or OTP;
(iii) the Member commits or is reasonably suspected of committing any fraud or misrepresents or is reasonably suspected of misrepresenting any information supplied or to be supplied by the Member; or
(iv) the Member commits a material breach of these Terms and such breach is either not capable of being remedied or if it is capable of remedied, the Member fails to remedy it within 30 days from the date of written notice by Company requiring such breach to be remedied.
(ข) บริษัทอาจยกเลิกหรือระงับบัญชีของสมาชิกและสมาชิกภาพในระบบสะสมคะแนนคาลเท็กซ์รีวอร์ด โดยให้มีผลโดยทันที หากเกิดเหตุการณ์ใด ๆ ดังต่อไปนี้
(1) สมาชิกไม่ได้ถือบัญชีหรือบัตรสะสมคะแนนคาลเท็กซ์รีวอร์ด (แล้วแต่กรณี) ที่ยังมีอายุการใช้งาน
(2) บัญชีของสมาชิกไม่มีการเคลื่อนไหวเป็นระยะเวลาติดต่อกันนานกว่า 36 เดือน ซึ่งในกรณีดังกล่าวนี้ บริษัทมีสิทธิ์แต่เพียงผู้เดียว (แต่ไม่มีหน้าที่ต้อง) ที่จะเปิดใช้งานบัญชีอีกครั้ง หากสมาชิกสามารถยืนยันการใช้งานผ่านรหัสประจำตัวหรือรหัสผ่านที่สามารถใช้ได้เพียงครั้งเดียวที่ได้รับทางหมายเลขโทรศัพท์เคลื่อนที่หรือที่อยู่อีเมลที่ให้ไว้สำหรับบัญชีดังกล่าว
(3) สมาชิกกระทำหรือมีเหตุอันควรสงสัยว่าได้กระทำการฉ้อโกง หรือให้หรือมีเหตุอันควรสงสัยว่าได้ให้หรือจะให้การรับรองข้อมูลใด ๆ ที่ไม่ถูกต้องตามความเป็นจริง หรือ
(4) สมาชิกผิดข้อสัญญาอันเป็นสาระสำคัญของข้อกำหนดฯ นี้ และการผิดสัญญาดังกล่าวไม่สามารถแก้ไขได้ หรือหากสามารถแก้ไขได้ แต่ไม่ได้รับการแก้ไขภายใน 30 วัน นับจากวันที่ได้รับการแจ้งเตือนเป็นลายลักษณ์จากบริษัทให้แก้ไขเหตุผิดสัญญาดังกล่าว
9.2 Termination by Member
9.2 การเลิกสัญญาโดยสมาชิก
A Member may withdraw from the Caltex Rewards Programme at any time by contacting Company's customer service centre at 02 081 4123 (office hour every day from 8.00 am to 8.00 pm. or email to thcsc@sprc.co.th) or via the Application.
สมาชิกอาจออกจากการเป็นสมาชิกของระบบสะสมคะแนนคาลเท็กซ์รีวอร์ดได้ตลอดเวลา โดยติดต่อผ่านศูนย์บริการลูกค้าของบริษัท ที่หมายเลขโทรศัพท์ 02 081 4123 (ในเวลาทำการตั้งแต่เวลา 8.00 – 20.00 นาฬิกา ของทุกวัน หรือทางอีเมลที่ thcsc@sprc.co.th) หรือผ่านทางแอปพลิเคชัน
9.3 Consequences of Termination

Upon termination of the Member's Account or the Caltex Rewards Programme, all Caltex Rewards Points accumulated in the Member's Account shall be forfeited.
หลักจากที่ได้มีการยกเลิกบัญชีของสมาชิกหรือระบบสะสมคะแนนคาลเท็กซ์รีวอร์ด คะแนนคาลเท็กซ์รีวอร์ดทั้งหมดที่สะสมอยู่ในบัญชีของสมาชิกจะถูกเรียกคืน
10. Liability and Indemnity

10.1 Member's Liability
Each Member assumes all risks and liabilities for loss or damage arising from his or her participation in the Caltex Rewards Programme.

สมาชิกแต่ละรายจะรับผิดชอบในความเสี่ยงภัยและความรับผิดสำหรับความสูญเสียและความเสียหายทุกประการที่เกิดจากการที่สมาชิกรายดังกล่าวได้เข้าร่วมระบบสะสมคะแนนคาลเท็กซ์รีวอร์ด
10.2 Indemnity
Each Member shall indemnify and hold each of the entities in the Company Group and their respective directors, officers, employees, agents and contractors harmless from and against any and all claims, proceedings, loss, damage, costs and expenses (including legal costs on a full indemnity basis) incurred, suffered or sustained by each of the entities in the Company Group and their respective directors, officers, employees, agents and contractors directly or indirectly arising from or relating to the Member’s participation in the Caltex Rewards Programme.

สมาชิกแต่ละรายตกลงชดใช้ความผิดและคุ้มครองบรรดานิติบุคคลในบริษัทในกลุ่มของเรา รวมทั้งกรรมการ เจ้าหน้าที่ ลูกจ้าง ตัวแทน และผู้รับจ้างของนิติบุคคลดังกล่าวจากบรรดาข้อเรียกร้อง การดำเนินคดี ความสูญเสีย ความเสียหาย ราคาและค่าใช้จ่าย (ซึ่งรวมถึงค่าวิชาชีพทนายความโดยเต็มจำนวน) ที่เกิดขึ้น ได้รับความเสียหาย หรือถูกเรียกร้องให้ชำระโดยนิติบุคคลใด ๆ ในบริษัทในกลุ่มของเรา รวมทั้งกรรมการ เจ้าหน้าที่ ลูกจ้าง ตัวแทน และผู้รับจ้างของนิติบุคคลดังกล่าว ไม่ว่าโดยทางตรงหรือทางอ้อม อันเกิดขึ้นจากหรือเกี่ยวข้องกับการที่สมาชิกเข้าร่วมระบบสะสมคะแนนคาลเท็กซ์รีวอร์ด
11. Disclaimer

11.1 General
11.1 ข้อกำหนดทั่วไป
(a) To the fullest extent permitted by law, each of the entities in the Company Group disclaims any liability whatsoever arising from or relating to the Member’s usage of the Application and/or participation in the Caltex Rewards Programme, howsoever arising, including but not limited to, the redemption and use of the rewards, any breakdown or malfunction in any computer system or equipment, any notice which is misdirected and/or lost in the post, loss of income, profits or goodwill, as well as any other direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties howsoever arising whether in contract, tort, negligence or otherwise.
(ก) นิติบุคคลแต่ละรายในบริษัทในกลุ่มของเราขอปฏิเสธความรับผิดใด ๆ ก็ตามที่เกิดขึ้นหรือเกี่ยวกับการใช้งานแอปพลิเคชันและ/หรือการเข้าร่วมระบบสะสมคะแนนคาลเท็กซ์รีวอร์ดของสมาชิก ตามขอบเขตสูงสุดเท่าที่กฎหมายกำหนดให้สามารถทำได้ ทั้งนี้ ไม่ว่าความรับผิดดังกล่าวจะเกิดขึ้นจากกรณีใดก็ตาม ซึ่งรวมถึง แต่ไม่จำกัดเฉพาะ การแลกและการใช้คะแนนรางวัล ความเสียหายหรือความผิดพลาดด้านใช้งานของระบบคอมพิวเตอร์หรืออุปกรณ์ใด ๆ หรือการประกาศใด ๆ ที่ส่งผิดพลาดและ/หรือเสียหายระหว่างการสื่อสาร การสูญเสียรายได้ กำไร หรือค่าความนิยม (goodwill) รวมทั้งความเสียหายใด ๆ ทั้งทางตรงหรือทางอ้อม ความเสียหายข้างเคียง ความเสียหายสืบเนื่อง ความเสียหายเชิงตัวอย่าง ความเสียหายเชิงลงโทษ หรือความเสียหายพิเศษสำหรับคู่สัญญาฝ่ายใด รวมถึงบุคคลภายนอก ทั้งที่เกิดจากมูลเหตุทางสัญญา ละเมิด ความประมาทเลินเล่อ หรือเหตุใด ๆ ก็ตาม
(b) To the fullest extent permitted by law, none of the entities in the Company Group shall be liable for any claim, loss, damage, cost or expense incurred, suffered or sustained by the Member arising from or in connection with:
(i) any failure or refusal by any merchant in accepting the Member's membership in the Caltex Rewards Programme or crediting of the Caltex Rewards Points into the Member's Account;
(ii) where a Caltex Rewards Card has been issued, the use of the Caltex Rewards Card;
(iii) any loss of data and records relating to the Member's Account or the Caltex Rewards Programme;
(iv) any loss of or inability to use the stored Caltex Rewards Points in the Member's Account;
(v) any acts, omissions, negligence or wilful default on the part of the merchant;
(vi) any acts, omissions, negligence or wilful default on the part of any of the entities in the Company Group and their respective directors, officers, employees, agents or contractors; or
(vii) any failure or inability of the Member to access the Application and/or his or her Account.
(ข) นิติบุคคลใด ๆ ในบริษัทในกลุ่มของเราจะไม่รับผิดต่อข้อเรียกร้อง ความสูญเสีย ความเสียหาย ราคาหรือค่าใช้จ่ายใด ๆ ที่เกิดขึ้น ได้รับความเสียหาย หรือถูกเรียกร้องให้ชำระโดยสมาชิก ตามขอบเขตสูงสุดเท่าที่กฎหมายกำหนดให้สามารถปฏิเสธความรับผิดได้ อันเกิดจากหรือเกี่ยวข้องกับเหตุดังต่อไปนี้
(1) ความผิดพลาดหรือการปฏิเสธโดยร้านค้าในการยอมรับสมาชิกภาพในระบบสะสมคะแนนคาลเท็กซ์รีวอร์ดของสมาชิกหรือการบันทึกคะแนนคาลเท็กซ์รีวอร์ดลงในบัญชีของสมาชิก
(2) การใช้บัตรสะสมคะแนนคาลเท็กซ์รีวอร์ด หากมีการออกใช้บัตรดังกล่าว
(3) ความสูญหายของข้อมูลหรือรายการบันทึกที่เกี่ยวกับบัญชีสมาชิกหรือระบบสะสมคะแนนคาลเท็กซ์รีวอร์ด
(4) ความสูญหายหรือเหตุที่ไม่สามารถใช้งานคะแนนคาลเท็กซ์รีวอร์ดที่สะสมไว้ในบัญชีของสมาชิก
(5) การกระทำ การงดเว้นการกระทำ ความประมาทเลินเล่อ หรือความจงใจฝ่าฝืนโดยฝ่ายร้านค้า
(6) การกระทำ การงดเว้นการกระทำ ความประมาทเลินเล่อ หรือความจงใจฝ่าฝืนโดยนิติบุคคลใด ๆ ในบริษัทในกลุ่มของเรา รวมทั้งกรรมการ เจ้าหน้าที่ ลูกจ้าง ตัวแทน และผู้รับจ้างของนิติบุคคลดังกล่าว หรือ
(7) ความผิดพลาดหรือเหตุที่ไม่สามารถเข้าใช้แอปพลิเคชันและ/หรือบัญชีของสมาชิก
(c) For the avoidance of doubt, termination or suspension by Company of the Caltex Rewards Programme shall not entitle any Member to any claim or compensation against any of the entities in the Company Group for any and all loss or damage suffered or incurred directly or indirectly as a result of such termination or suspension.
(ค) เพื่อความชัดเจน การยกเลิกหรือระงับระบบสะสมคะแนนคาลเท็กซ์รีวอร์ดโดยบริษัทไม่ก่อให้เกิดสิทธิ์ใด ๆ แก่สมาชิกในการเรียกร้องหรือได้รับค่าสินไหมทดแทนใด ๆ จากนิติบุคคลในบริษัทในกลุ่มของเราสำหรับความสูญเสียหรือความเสียหายที่ได้รับหรือเกิดขึ้นไม่ว่าโดยตรงหรือโดยอ้อมจากการยกเลิกหรือระงับดังกล่าว
11.2 Accumulation of Caltex Rewards Points
11.2 การสะสมคะแนนคาลเท็กซ์รีวอร์ด
The Member agrees that the Caltex Rewards Cards (if issued) are intended to be used as loyalty cards for the accumulation of the Caltex Rewards Points for eligible purchases and that Company does not make any representation or warranty with respect to any goods and/or services purchased, whether or not the purchase qualifies for the award of the Caltex Rewards Points. None of the entities in the Company Group shall be liable for any claim, loss, damage, injury, death, costs or expenses howsoever incurred, suffered or sustained by the Member as a result of or in connection with the purchase of such goods and/or services. The Member agrees to direct all claims in relation to such goods and/or services to the relevant supplier, manufacturer or such appropriate third party concerned with the supply of such goods and/or services.
สมาชิกตกลงว่าบัตรสะสมคะแนนคาลเท็กซ์รีวอร์ด (ถ้ามีการออกใช้งาน) มีขึ้นเพื่อวัตถุประสงค์ในการใช้งานเพื่อเป็นบัตรสะสมคะแนนคาลเท็กซ์รีวอร์ดสำหรับการใช้จ่ายที่ร่วมรายการเท่านั้น และบริษัทไม่รับรองหรือรับประกันใด ๆ เกี่ยวกับสินค้าและ/หรือบริการดังกล่าว นิติบุคคลในบริษัทในกลุ่มของเราจะไม่รับผิดใด ๆ ต่อข้อเรียกร้อง ความสูญเสีย ความเสียหาย การบาดเจ็บ การสูญเสียชีวิต ราคาหรือค่าใช้จ่ายใด ๆ ก็ตามที่เกิดขึ้น ได้รับความเสียหาย หรือถูกเรียกร้องให้ชำระโดยสมาชิก ซึ่งเกิดขึ้นหรือเกี่ยวข้องกับการซื้อสินค้าหรือบริการดังกล่าว โดยสมาชิกตกลงที่จะเรียกร้องโดยตรงต่อผู้จัดหาหรือผู้ผลิตที่เกี่ยวข้องกับสินค้าหรือบริการดังกล่าว หรือต่อบุคคลภายนอกที่เหมาะสมซึ่งเกี่ยวข้องกับการจัดหาสินค้าหรือบริการดังกล่าว
11.3 Redemption of Caltex Rewards Points
11.3 การแลกใช้คะแนนคาลเท็กซ์รีวอร์ด
(a) The Member acknowledges and accepts that the use of the Caltex Rewards Points to offset payments shall constitute a contract for sale between the Member and such merchant. As such, none of the entities in the Company Group assumes any liability in respect of any goods and/or services purchased by the Member from the merchant using the Caltex Rewards Points. The Member agrees to direct all claims in relation to such goods and/or services to the relevant merchant or such appropriate third party concerned with the supply of the relevant goods and/or services.
(ก) สมาชิกรับรู้และยอมรับว่าการใช้คะแนนคาลเท็กซ์รีวอร์ดเพื่อหักลดกับการชำระราคาถือเป็นการทำสัญญาซื้อขายระหว่างสมาชิกกับร้านค้าดังกล่าว ในกรณีนี้ นิติบุคคลในบริษัทในกลุ่มของเราจะไม่รับผิดใด ๆ เกี่ยวกับการซื้อสินค้าและ/หรือบริการโดยสมาชิกจากร้านด้วยคะแนนคาลเท็กซ์รีวอร์ด โดยสมาชิกตกลงที่จะเรียกร้องโดยตรงต่อร้านค้าเกี่ยวกับสินค้าหรือบริการดังกล่าว หรือต่อบุคคลภายนอกที่เหมาะสมซึ่งเกี่ยวข้องกับการจัดหาสินค้าหรือบริการดังกล่าว
(b) None of the entities in the Company Group shall be liable for any loss or damage suffered or incurred by the Members directly or indirectly in connection with their participation in the Partner’s Programme and/or the conversion of Caltex Rewards Points into Partner’s loyalty points.
(ข) นิติบุคคลในบริษัทในกลุ่มของเราจะไม่รับผิดใด ๆ ต่อความสูญเสียหรือความเสียหายที่สมาชิกได้รับหรือเกิดขึ้น ไม่ว่าโดยตรงหรือโดยอ้อม เกี่ยวกับการเข้าร่วมระบบสะสมคะแนนของพันธมิตรทางธุรกิจและ/หรือการแลกเปลี่ยนคะแนนคาลเท็กซ์รีวอร์ดกับคะแนนรางวัลของพันธมิตรทางธุรกิจ
(c) To the fullest extent permitted by law, none of the entities in the Company Group makes any representations or warranties, express or implied, and disclaims any and all liabilities as to the condition, quality, merchantability or fitness for use or purpose of any goods and/or services provided to the Member upon redemption of the Caltex Rewards Points.
(ค) นิติบุคคลในบริษัทในกลุ่มของเราไม่รับรองหรือรับประกันใด ๆ ไม่ว่าโดยชัดแจ้งหรือโดยปริยาย และปฏิเสธความรับผิดใด ๆ เกี่ยวกับสภาพ คุณภาพ ความสามารถในการค้าขายได้ หรือความเหมาะสมสำหรับการใช้หรือตามวัตถุประสงค์ของสินค้าและ/หรือบริการใด ๆ ที่สมาชิกได้รับจากการแลกคะแนนคาลเท็กซ์รีวอร์ด ทั้งนี้ ตามขอบเขตสูงสุดเท่าที่กฎหมายกำหนดให้สามารถปฏิเสธความรับผิดได้
12. Limitation of Liability
12. ข้อจำกัดความรับผิด
To the fullest extent permitted under applicable law, under no circumstances, including, but not limited to, negligence, shall any of the entities in the Company Group be liable for any compensatory, punitive, indirect, special or consequential damages that result from the use of, or the inability to use, the Application, the Account, (where applicable) the Caltex Rewards Card and/or the Caltex Rewards Programme, even if Company or a Company authorised representative has been advised of the possibility of such damages. Applicable law may not allow the limitation or exclusion of liability or incidental or consequential damages, and so to that extent the above limitation or exclusion may not apply to you. In no event shall Company's total liability (or the total liability of any of the entities in the Company Group) to you for all damages, losses, and causes of action (whether in contract, tort (including, but not limited to, negligence) or otherwise) exceed the amount paid by you to Company, if any, for using the Application, the Account, (where applicable) the Caltex Rewards Card and/or the Caltex Rewards Programme.
ตามขอบเขตสูงสุดเท่าที่กฎหมายที่บังคับใช้กำหนดให้สามารถปฏิเสธความรับผิดได้ นิติบุคคลในบริษัทในกลุ่มของเราจะไม่รับผิดต่อค่าสินไหมทดแทน ค่าเสียหายในเชิงลงโทษ ค่าเสียหายทางอ้อม ค่าเสียหายพิเศษ หรือค่าเสียหายสืบเนื่อง อันเกิดจากการใช้งานหรือเหตุที่ไม่สามารถใช้งานแอปพลิเคชัน บัญชี บัตรสะสมคะแนนคาลเท็กซ์รีวอร์ด (ถ้ามี) และ/หรือระบบสะสมคะแนนคาลเท็กซ์รีวอร์ด ไม่ว่าด้วยเหตุใด ๆ ก็ตาม ซึ่งรวมถึงแต่ไม่จำกัดเฉพาะความประมาทเลินเล่อ และแม้กระทั่งบริษัทหรือตัวแทนผู้รับมอบอำนาจของบริษัทจะได้รับแจ้งให้ทราบถึงความเป็นไปได้ของค่าเสียหายดังกล่าวแล้วก็ตาม อย่างไรก็ตาม หากกฎหมายที่บังคับใช้ไม่อนุญาตให้มีการจำกัดหรือยกเว้นความรับผิดหรือค่าเสียหายข้างเคียงหรือค่าเสียหายสืบเนื่อง ก็ให้บังคับใช้ข้อจำกัดหรือยกเว้นความรับผิดเท่าที่กฎหมายที่บังคับใช้จะอนุญาตให้สามารถจำกัดหรือปฏิเสธความรับผิดได้ ทั้งนี้ ความรับผิดทั้งหมดของบริษัท (หรือความรับผิดทั้งหมดของนิติบุคลลในบริษัทในกลุ่มของเรา) ต่อท่านสำหรับความเสียหาย ความสูญเสีย และการดำเนินการใด ๆ ตามกฎหมาย (ไม่ว่าโดยมูลเหตุทางสัญญา ละเมิด (ซึ่งรวมถึงแต่ไม่จำกัดเฉพาะความประมาทเลินเล่อ) หรือเหตุใด ๆ ก็ตาม) จะไม่เกินกว่าไปจำนวนเงินที่ท่านได้ชำระให้แก่บริษัท (ถ้ามี) จากการใช้งานแอปพลิเคชัน บัญชี บัตรสะสมคะแนนคาลเท็กซ์รีวอร์ด (ถ้ามี) และ/หรือระบบสะสมคะแนนคาลเท็กซ์รีวอร์ด
13. Trademarks
All trademarks, service marks, logos and trade names, whether registered or unregistered, are proprietary to Company or to other companies where so indicated. You may not reproduce, download or otherwise use any such trademarks, service marks, logos or trade names without the prior written consent of the appropriate owner thereof.

บรรดาเครื่องหมายการค้า เครื่องหมายบริการ โลโก้ และชื่อทางการค้า ไม่ว่าจะได้จดทะเบียนแล้วหรือไม่ก็ตาม เป็นกรรมสิทธิ์ของบริษัท หรือบริษัทอื่น ๆ ตามที่ระบุ ท่านไม่มีสิทธิ์ทำซ้ำ ดาวน์โหลด หรือใช้โดยประการใด ๆ ซึ่งเครื่องหมายการค้า เครื่องหมายบริการ โลโก้ และชื่อทางการค้าดังกล่าวโดยไม่ได้รับความยินยอมเป็นลายลักษณ์อักษรจากผู้ทรงสิทธิ์
14. Access to Linked Sites
14. การเข้าถึงเว็บไซต์ที่ถูกเชื่อมโยง
The Members may be able to access Linked Sites. Linked Sites are not reviewed, controlled, or examined by any of the entities in the Company Group in any way and none of the entities in the Company Group is responsible for the content, availability, advertising, products or other materials of any such Linked Sites, or any additional links contained therein. These links do not imply Company Group’s endorsement of, association, partnership or any other relationship with the Linked Sites and/or their operators. It is the sole responsibility of the Members to comply with the terms of service and privacy policy of the Linked Sites as well as with any other obligation under copyright, secrecy, defamation, decency, privacy, security and export laws related to the use of such Linked Sites and any content contained thereon. In no event shall any of the entities in the Company Group be liable, directly or indirectly, to anyone for any loss or damage arising from or occasioned by the creation or use of the Linked Sites or the information or material accessed through these Linked Sites. Any concerns should be directed to the relevant Linked Site’s administrator or webmaster. Company reserves the exclusive right, at its sole discretion, to add, change, decline or remove, without notice, any link to any of the Linked Sites from the Application and/or introduce different links to different Members.

15. Collection, Use and Disclosure of Personal Data

The collection, use and disclosure of the Members’ personal data will be in accordance with Company's Privacy Statement which is available here here. By using his or her Caltex Rewards Card or by logging into his or her Account to participate in the Caltex Rewards Programme, the Member shall be deemed to have read, understood and accepted the terms of Company’s Privacy Statement. For enquiries relating to Company’s Privacy Statement, please contact the customer service centre at 02 081 4123 (office hour every day from 8.00 am to 8.00 pm. or email to SFLPrivacy@sprc.co.th or mailing to Company’s Privacy Officer, Star Fuels Marketing Limited, 19, Tower 3, SCB Park Plaza, 7th Floor, Ratchadapisek Road, Chatuchak, Chatuchak, Bangkok 10900 (Thailand).

16. Miscellaneous
16. ข้อกำหนดอื่น ๆ
16.1 Entire Agreement
This is the entire agreement between you and Company relating to the subject matter herein and shall not be modified except in writing or in accordance with paragraph 16.2.
16.1 ข้อตกลงทั้งหมด
ข้อกำหนดฯ นี้ เป็นข้อตกลงทั้งหมดระหว่างท่านกับบริษัทเกี่ยวกับเรื่องที่ระบุในข้อกำหนดฯ นี้ และไม่อาจแก้ไขเปลี่ยนแปลงได้ เว้นแต่จะได้ทำเป็นหนังสือตามที่กำหนดไว้ข้อ 16.2
16.2 Variation
(a) Company reserves the right to modify, update, replace or change any or all of these Terms or its policies relating to the Caltex Rewards Programme at any time and from time to time, by posting an updated or revised version on Company's website (here) or the Application. Any modification, update, replacement or change to the Terms or any policy relating to the Caltex Rewards Programme shall be effective upon posting of the updated or revised version. Although Company will endeavour to highlight material updates or changes to these Terms, it is your responsibility to review these Terms regularly to ensure you are aware of the most recent terms as they will be binding on you and your participation in the Caltex Rewards Programme. Your continued participation in the Caltex Rewards Programme will be deemed to constitute your agreement to and acceptance of such changes. If you do not agree to any update or change, you must immediately cease participating in the Caltex Rewards Programme.
(b) Further, Company may at any time and from time to time introduce updates, enhancements, changes or new features to the Caltex Rewards Programme. Any such changes or new features introduced will be subject to these Terms.
16.2 การเปลี่ยนแปลง
(ก) บริษัทสงวนสิทธิ์ในการเปลี่ยนแปลง ปรับปรุง แทนที่ หรือแก้ไขข้อกำหนดฯ นี้ ข้อหนึ่งข้อใดหรือทั้งหมด หรือนโยบายของบริษัทเกี่ยวกับระบบสะสมคะแนนคาลเท็กซ์รีวอร์ดได้ตลอดเวลาและเป็นครั้งคราว โดยการเผยแพร่ฉบับแก้ไขหรือปรับปรุงบนเว็บไซต์ของบริษัท (ที่นี่) หรือบนแอปพลิเคชัน การเปลี่ยนแปลง ปรับปรุง แทนที่ หรือแก้ไขข้อกำหนดฯ นี้ หรือนโยบายของบริษัทเกี่ยวกับระบบสะสมคะแนนคาลเท็กซ์รีวอร์ดให้มีผล ณ วันที่มีการเผยแพร่ฉบับแก้ไขหรือปรับปรุง ทั้งนี้ บริษัทจะใช้ความพยายามในการชี้แจงรายการปรับปรุงหรือแก้ไขที่สำคัญของข้อกำหนดฯ ให้ท่านทราบ แต่ยังคงเป็นหน้าที่ของท่านในการตรวจสอบข้อกำหนดนี้ฯ อยู่เป็นประจำเพื่อให้มั่นใจได้ว่าท่านได้รับทราบข้อกำหนดล่าสุดที่ผูกพันท่านและการเข้าร่วมระบบสะสมคะแนนคาลเท็กซ์รีวอร์ด การเข้าร่วมระบบสะสมคะแนนคาลเท็กซ์รีวอร์ดอย่างต่อเนื่องของท่านจะถือเป็นการเข้าทำสัญญาและยอมรับการเปลี่ยนแปลงข้อกำหนดฯ ของท่าน ในกรณีที่ท่านไม่เห็นด้วยกับการปรับปรุงหรือเปลี่ยนแปลงข้อกำหนดฯ ท่านจะต้องระงับการเข้าร่วมระบบสะสมคะแนนคาลเท็กซ์รีวอร์ดโดยทันที
(ข) นอกจากนี้ บริษัทอาจปรับปรุง พัฒนา แก้ไข หรือนำใช้ปฏิการรูปแบบใหม่บนระบบสะสมคะแนนคาลเท็กซ์รีวอร์ดได้ตลอดเวลาและเป็นครั้งคราว โดยการแก้ไขหรือการนำใช้ปฏิการรูปแบบใหม่ดังกล่าวจะอยู่ภายใต้ข้อกำหนดฯ นี้
16.3 Assignment
(a) No rights of any Member against Company under these Terms may be assigned or otherwise disposed of.
(b) Company may at any time assign or transfer all or any part of its rights and/or obligations under these Terms relating to any Account, Caltex Rewards Cards and/or the Caltex Rewards Programme without the prior consent of any Member.
16.3 การโอนสิทธิ
(ก) สมาชิกไม่อาจโอนหรือจำหน่ายด้วยประการใด ๆ ซึ่งสิทธิ์ใด ๆ ที่สมาชิกมีต่อบริษัทตามข้อกำหนดฯ นี้
(ข) บริษัทอาจโอนสิทธิ์หรือหน้าที่ใด ๆ ของตนที่มีอยู่ตามข้อกำหนดฯ นี้ ในส่วนที่เกี่ยวกับบัญชี บัตรสะสมคะแนนคาลเท็กซ์รีวอร์ด และ/หรือระบบสะสมคะแนนคาลเท็กซ์รีวอร์ด ไม่ว่าทั้งหมดหรือแต่บางส่วน โดยไม่จำเป็นต้องได้รับความยินยอมล่วงหน้าจากสมาชิก
16.4 Severability
If any provision of these Terms shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
16.4 ความสมบูรณ์แยกส่วน
ถ้าส่วนใดของข้อกำหนดฯ นี้ขัดต่อกฎหมาย ตกเป็นโมฆะ หรือไม่สามารถบังคับได้ ไม่ว่าด้วยเหตุผลใดก็ตาม ให้ส่วนดังกล่าวของข้อกำหนดฯ แยกส่วนออกจากข้อกำหนดฯ นี้ และไม่กระทบกระเทือนถึงความสมบูรณ์และการบังคับใช้ของส่วนที่เหลือของข้อกำหนดฯ
16.5 Remedies
No failure to exercise or delay in exercising any right, power or remedy under these Terms operates as a waiver. A single or partial exercise or waiver of the exercise of any right, power or remedy does not preclude any other or further exercise of that or any other right, power or remedy. A waiver is not valid or binding on the party granting that waiver unless made in writing.
16.5 การเยียวยา
การไม่ดำเนินการหรือความล่าช้าในการใช้สิทธิ์ อำนาจ หรือการเยียวยาใด ๆ ตามข้อกำหนดฯ นี้ ไม่ถือเป็นการสละสิทธิ์ อีกทั้งการใช้สิทธิเพียงครั้งเดียวหรือแต่บางส่วนหรือการสละสิทธิ์ อำนาจ หรือการเยียวยาใด ๆ ไม่ถือเป็นการตัดสิทธิ์อื่น ๆ หรือสิทธิเพิ่มเติมของสิทธิ์ อำนาจ หรือการเยียวยาดังกล่าวหรือสิทธิ์อื่น ๆ การสละสิทธิ์ใด ๆ นั้นไม่สมบูรณ์หรือผูกพันผู้สละสิทธิ์ดังกล่าว เว้นแต่จะได้ทำเป็นหนังสือ
16.6 Third Party Rights
Save as expressly stated otherwise, no third party shall have any right to enforce any provision of these Terms.
16.6 สิทธิ์ของบุคคลภายนอก
เว้นแต่จะได้กำหนดไว้อย่างชัดแจ้ง บุคคลภายนอกไม่อาจอ้างสิทธิ์ใด ๆ ตามข้อกำหนดฯ นี้
16.7 Governing Law and Dispute Resolution
(a) These Terms shall be governed by and construed in accordance with the laws of Thailand, without giving effect to any principles of conflicts of law.
(b) By participating in the Caltex Rewards Programme, you submit to the non-exclusive jurisdiction of the Thai courts.
16.7 กฎหมายที่ใช้บังคับและการระงับข้อพิพาท
(ก) ข้อกำหนดฯ นี้อยู่ภายใต้บังคับและการตีความตามกฎหมายไทย โดยไม่นำหลักการขัดกันแห่งกฎหมายมาใช้บังคับ
(ข) โดยการเข้าร่วมระบบสะสมคะแนนคาลเท็กซ์รีวอร์ด ให้ถือว่าท่านยอมรับเขตอำนาจแบบไม่เด็ดขาดของศาลไทย
