These are the terms and conditions of the Caltex Rewards Program. By participating in the Caltex Rewards Program, you agree to be bound by the Terms as set out.
Definitions
In these Terms, the following terms shall have the meanings as set forth below, save where the context otherwise requires:
(a) "Account" means a user account on the Application or records;
(b) "Application" means the CaltexGO mobile application;
(e) "Caltex Rewards Card" means the card which reflects a Member's membership in the Caltex Rewards Program, which may be a digital card issued on the Application and linked to either your Account, or a member’s registered mobile number with the Caltex Rewards Program;
(f) "Caltex Rewards Points" means the loyalty points issued to Members in accordance with the Caltex Rewards Program;
(g) "Caltex Rewards Program" means the loyalty rewards program owned and managed by Chevron, the terms and conditions of which are set out in these Terms as updated and notified to you by Chevron from time to time;
(h) "Chevron" or "we" (including its variations "our" and "us") means Chevron Australia Downstream Pty Ltd.
(i) "Chevron Group" means collectively Chevron and its parent and other affiliated or related companies;
(j) "Chevron Privacy Statements" means the CaltexGO Privacy Statement and the Chevron Website Privacy Statement;
(k) "Chevron's Website" means the website located at the following URL, as updated by Chevron from time to time: https://www.caltex.com/au
(m) "Contact Chevron" means to communicate with Chevron via the Application, through Chevron's Website, or by calling 1300 723 706.
(n) "Linked Sites" means the third-party websites that may be linked via the Application or Chevron's Website in connection with the Caltex Rewards Program;
(o) "Member" or "you" means a person who has been approved by Chevron to participate in the Caltex Rewards Program;
(p) "Promotional Program" means any special promotion which may form part of the Caltex Rewards Program from time to time, including any contest, lucky draw, program, activity or event organised by Chevron (whether solely or jointly with any other partners or collaborators), and which may be subject to additional terms and conditions;
(q) "Station" means any Caltex service station situated in the Territory;
(r) "Terms" means these terms and conditions, and all terms incorporated by reference without any limitation or qualification, including the applicable terms and conditions of any Promotional Program; and
(s) "Territory" means Australia.
Program Overview
With the aim of facilitating better connections with its customers, Chevron has implemented the Caltex Rewards Program. The Caltex Rewards Program enables Members to earn and redeem Caltex Rewards Points, in accordance with these Terms and any other such terms and conditions determined by Chevron from time to time and notified to its customers.
Eligibility & Registration
4.1 Eligibility Criteria
Any individual person aged 18 or above located in the Territory may apply to be a Member. Chevron reserves the right to reasonably determine, the eligibility of any individual as a Member and to reject any application for the Caltex Rewards Program. Chevron will notify an individual if it rejects their application for the Caltex Rewards Program. That individual may Contact Chevron to request that Chevron reviews its decision to reject the application. Chevron must consider the individual's application and notify them of the outcome of its review within a reasonable time.
4.2 Registration Process
(a) In order to participate in the Caltex Rewards Program, you will need to submit an application via the Application. Unless you have successfully completed the application process and been approved by Chevron pursuant to the Terms, you will not be able to earn or redeem any Caltex Rewards Points under the Caltex Rewards Program.
(b) All mandatory fields specified in the application for the Caltex Rewards Program (including your full name, month and year of birth, mobile phone number and a valid email address) must be completed and validated for the application to be processed. Chevron may contact you through the email address and/or mobile number you have provided regarding the Caltex Rewards Program, and for other purposes as may be mentioned in these Terms and the Chevron Privacy Statements.
Membership & Caltex Rewards Cards
5.1 Approval for Membership
(a) Upon approval of your application by Chevron, Chevon may issue a digital Caltex Rewards Card or other digital code associated with your membership, and your membership in the Caltex Rewards Program will be reflected in your Account. Upon your membership in the Caltex Rewards Program being reflected in your Account, you may commence participating in the Caltex Rewards Program through making qualifying purchases for the purposes of accumulating the Caltex Rewards Points and redeeming them for rewards, subject to the Terms.
(b) You acknowledge that your membership in the Caltex Rewards Program is personal to you, and shall not be transferred to any other person.
(c) The Application and your membership in the Caltex Rewards Program is otherwise subject to the CaltexGO Terms of Use.
5.2 Representations and Warranties by Member
You represent and warrant that all information provided in connection with the registration and participation in the Caltex Rewards Program is true, accurate and not misleading, and will remain true, accurate and not misleading for as long as you remain as a Member. In the event of any changes to your details or particulars from time to time, it is your responsibility to Contact Chevron within a reasonable time period to have these details or particulars updated.
5.3 Rights of Chevron
Chevon may do any or all of the following with prior notice to the relevant Members as appropriate:
(a) suspend or terminate the Caltex Rewards Program, without compensation to any Member;
(b) suspend or terminate any Caltex Rewards Card or any membership in the Caltex Rewards Program, which may result in the forfeiture of the Caltex Rewards Points associated with such Caltex Rewards Card or membership in the Caltex Rewards Program, without any compensation to the Member for any reason including, but not limited to:
(i) the Member no longer holds a valid Account or Caltex Rewards Card (as the case may be); or
(ii) the Member's Account does not have any activity for a continuous period of 36 months;
(c) refuse to renew the Member's membership in the Caltex Rewards Program;
(d) terminate an existing Caltex Rewards Card and assign a new Caltex Rewards Card with a new card number to the Member; or
(e) introduce, amend, restrict, suspend, terminate or make any changes to any or all of the benefits, services, facilities and privileges in respect of or in connection with the Caltex Rewards Cards and/or the Caltex Rewards Program.
Accumulation and Validity of Caltex Rewards Points
6.1 Methods to Earn Caltex Rewards Points
You can earn Caltex Rewards Points via any of the following methods:
(a) purchase of fuel at any Station; or
(b) such other method as Chevron may notify from time to time,
subject to the Terms (including but not limited to minimum spend conditions and verification requirements) as may be determined by Chevron from time to time. Additional Caltex Rewards Points may be issued by Chevron during Promotion Programs.
6.2 Rate of collection of Caltex Rewards Points
(a) Subject to the remainder of the Terms (particularly paragraphs 6.3 and 7.1), You can earn Caltex Rewards Points at the following rates:
(i) Premium Unleaded 98: 2 Caltex Rewards Points for every whole litre purchased; and
(ii) Petrol, Diesel and other fuels at the pump: 1 Caltex Reward Point for every whole litre purchased (includes Unleaded, Premium Unleaded 95, Regular Diesel, Premium Diesel, E10, LPG, Opal and Ad Blue sold at pump).
(b) At times, Chevron will run Promotional Programs where you can collect bonus Caltex Rewards Points. Some of these promotions may be exclusive personalised offers to collect bonus Caltex Rewards Points based on your individual profile, and will be available only on your Caltex Rewards Card.
6.3 Restrictions to Earn Caltex Rewards Points
(a) In addition to the above, Chevron shall record and credit the Caltex Rewards Points only at the point of purchase, subject to Chevron's verification of the validity of your membership in the Caltex Rewards Program. No Caltex Rewards Points will be awarded for any previous or backdated receipts. You will not earn points above any of the following transaction limits:
(i) 120 litres per transaction;
(ii) 4 transactions per day; or
(iii) 15,000 litres per month.
(b) Caltex Rewards Points will be awarded based on your actual spend (Actual spend = Original amount – (discount + pay with points)).
(c) If Chevron has a reasonable belief that any of the Restrictions to Earn Caltex Rewards Points set out above in paragraph 6.3(a) apply, Chevron may, acting reasonably, do any of the following:
(i) delay the recording and crediting of such Caltex Rewards Points in your Account until it is satisfied whether the relevant restrictions apply;
(ii) refuse to record and credit such Caltex Rewards Points in your Account; or
(iii) if the Caltex Rewards Points have already been recorded and credited into the Member’s Account, cancel and deduct such Caltex Rewards Points from such Account.
(d) Any decision made by Chevron under this paragraph 6.3 shall be final and binding, unless the decision was made due to Chevron's error or fault.
6.4 Accumulation of Caltex Rewards Points
You can check your accumulated Caltex Rewards Points and your transaction history by logging into your Account on the Application. For the avoidance of doubt, Chevron will not provide periodic updates or a physical statement to you regarding your accumulated Caltex Rewards Points.
6.5 Validity
(a) Caltex Rewards Points validly earned will expire two (2) years after the date they were earned (as an example, Caltex Rewards Points earned on 1 October 2023 will expire on 30 September 2025). Chevron reserves the right to amend the validity period of the Caltex Rewards Points from time to time with prior notice to the Members.
(b) The Caltex Rewards Points are automatically void upon termination of the Caltex Rewards Program, or when you cease to be a Member. Members shall not be entitled to any compensation in respect of any cancellation of Caltex Rewards Points by Chevron pursuant to these Terms.
6.6 Non-transferable
The Caltex Rewards Points accumulated in your Account cannot be transferred or assigned to any other Member.
7. Redemption of Caltex Rewards Points
7.1 Conditions to Redemption
(a) You may only redeem Caltex Rewards Points after you have collected 500 Caltex Rewards Points in your Account and the Caltex Rewards Points are eligible for such redemption, subject to fulfilling any terms and conditions as may be imposed by Chevron from time to time. The Caltex Rewards Points utilised for redemption shall be on a first-in-first-out basis.
(b) In order to redeem the Caltex Rewards Points for fuel, a Member must present their membership in the Caltex Rewards Program at the point of purchase (by presenting their membership QR code, or other evidence of membership required by Chevron). A Member who fails to present their membership at the point of such redemption will not be permitted to redeem the Caltex Rewards Points.
(c) Chevron reserves the right to adjust (whether by way of an increase or a decrease) the Caltex Rewards Points required for redemption.
(d) All redemptions are subject to availability and change, and Chevron reserves the right to cancel, amend, substitute or remove any rewards without prior notice to the Members.
(e) Chevron will make reasonable efforts to ensure current information relating to rewards and redemption is made available to Members on the Chevron website or on the Application.
(f) Notwithstanding anything contained herein, the Caltex Rewards Points are not convertible to cash.
7.2 Offsetting Payments
The Members may use their Caltex Rewards Points to offset payments for fuel purchases at any Station, whether partially or fully. The redemption of the Caltex Rewards Points for offsetting payments is subject to the following:
(a) Caltex Rewards Points can only be redeemed in increments of 500 points;
(b) there is however, no limit to the number of 500 point increments that can be used to offset payments for fuel purchases at Stations in any one transaction;
(c) unless permitted in these Terms, any deduction of the Caltex Rewards Points from the Account shall not be refunded to you for any reason whatsoever unless the deduction was made due to Chevron's error, negligence or default; and
(d) in the event that payment still needs to be made by you after offsetting the purchase price against the redeemed Caltex Rewards Points, you shall make the necessary payment.
8. Account
8.1 Changes to the Account
Notwithstanding any other provisions in these Terms, Chevron reserves the right to make reasonably necessary changes to your Account (including but not limited to crediting or deducting Caltex Rewards Points from your Account, or suspending or terminating the Account) without prior notice to you to rectify the occurrence of any of the following circumstances:
(a) wrongful crediting, deduction or redemption of the Caltex Rewards Points arising from:
(i) system glitches, malfunction, failure or disruption with respect to the Account and/or the Application;
(ii) human error;
(iii) dishonest or fraudulent transactions, acts or omissions conducted by you or with respect to your Account; or
(iv) operational mistakes or changes; or
(b) inaccurate, false, misleading or illegible information supplied by the Member.
8.2 Representations and Warranties by Member
You represent and warrant that:
(a) you will not create more than one Account for the Application;
(b) you will not share your password or allow any other person to access your Account, or otherwise do anything that may or will violate the security of your Account;
(c) you will keep all information provided by you through the Application up to date and accurate;
(d) you will not transfer your Account to any other person;
(e) you are responsible for the use of your Account and all activities that are carried out through the Account that are reasonably within your control; and
(f) you will contact Chevron immediately if you become aware of any unauthorised use of or access to your Account, and comply with all reasonable directions given to you by Chevron in connection with any actual or suspected unauthorised access to your Account.
9. Termination
9.1 Termination without notice by Chevron
(a) Chevron may terminate or suspend your Account and Membership in the Caltex Rewards Program with immediate effect if any one or more of the following shall occur:
(i) the Member commits or is reasonably suspected of committing any fraud or misrepresents or is reasonably suspected of misrepresenting any information supplied by the Member; or
(ii) the Member commits a material breach of these Terms and such breach is either not capable of being remedied or if it is capable of remedied, the Member fails to remedy it within 30 days from the date of written notice by Chevron requiring such breach to be remedied.
9.2 Termination by Member
(a) You may withdraw from the Caltex Rewards Program at any time. If you wish to withdraw from the Caltex Rewards Program, you must Contact Chevron to provide notice of such. Upon providing notice, you will have a 30-day notice period in which to redeem any accumulated Caltex Rewards Points before your termination takes effect.
(b) Chevron will take reasonable steps to remind you of the consequences of termination under paragraph 9.3 at the time you notify Chevron of termination. If you wish to withdraw from the Caltex Rewards Program immediately, Chevron will waive the 30-day notice period and terminate your Account at your request. You agree that by advising Chevron you wish to withdraw from the Caltex Rewards Program immediately, you will also forfeit any accumulated Caltex Rewards Points immediately.
9.3 Consequences of Termination
Upon termination of your Account or the Caltex Rewards Program, all Caltex Rewards Points accumulated in your Account shall be forfeited.
10. Liability and Indemnity
10.1 Member's Liability
Each Member assumes all risks and liabilities for loss or damage arising from their participation in the Caltex Rewards Program except to the extent this loss or damage is caused by Chevron's negligence, wilful misconduct, or fraud.
10.2 Accumulation of Caltex Rewards Points
The Member agrees that the Caltex Rewards Cards (if issued) are intended to be used as loyalty cards for the accumulation of the Caltex Rewards Points for eligible purchases and that Chevron does not make any representation or warranty under this Agreement with respect to any goods and/or services purchased, whether or not the purchase qualifies for the award of the Caltex Rewards Points. To the maximum extent permitted by applicable law, none of the entities in the Chevron Group shall be liable under this Agreement for any claim, loss, damage, injury, death, costs or expenses howsoever incurred, suffered or sustained by the Member as a result of or in connection with the purchase of such goods and/or services. The Member agrees to direct all claims in relation to such goods and/or services to the relevant supplier, manufacturer or such appropriate third party concerned with the supply of such goods and/or services.
10.3 Redemption of Caltex Rewards Points
(a) The Member acknowledges and accepts that the use of the Caltex Rewards Points to offset payments shall constitute a contract for sale between the Member and such merchant. As such, none of the entities in the Chevron Group assumes any liability under this Agreement in respect of any goods and/or services purchased by the Member from the merchant using the Caltex Rewards Points. The Member agrees to direct all claims in relation to such goods and/or services to the relevant merchant or such appropriate third party concerned with the supply of the relevant goods and/or services.
(b) To the fullest extent permitted by law, none of the entities in the Chevron Group makes any representations or warranties, express or implied, and disclaims any and all liabilities as to the condition, quality, merchantability or fitness for use or purpose of any goods and/or services provided to the Member upon redemption of the Caltex Rewards Points.
11. Limitation of Liability
(a) To the extent permitted under applicable law (including the Australian Consumer Law) under no circumstances, including, but not limited to, negligence, shall any member of the Chevron Group be liable for any direct and indirect loss, damage or expense – irrespective of the manner in which it occurs – which may be suffered by your use of, or inability to use, the Application, the Account, and/or the Caltex Rewards Program and/or the information or materials contained on it, or as a result of the inaccessibility of this Application, the Account or the Caltex Rewards Program and/or the fact that certain information or materials contained on it are incorrect, incomplete or not up-to-date.
(b) Where any applicable law (including the Australian Consumer Law) implies any warranties, guarantees or conditions or imposes obligations upon Chevron which cannot be excluded, restricted or modified except to a limited extent ("Non-Excludable Guarantees"), these Terms must be read subject to those statutory provisions and Non-Excludable Guarantees. The above limitation of liability will not apply to the extent those Non-Excludable Guarantees apply and (in that case) Chevron's liability for breach of those Non-Excludable Guarantees only will instead be limited at its option to:
(i) in the case of any goods supplied by Chevron, either replacement of the goods or supply of equivalent goods, the repair of the goods, payment of the cost of replacing the goods or acquiring equivalent goods or payment of the cost of having the goods repaired; or
(ii) in the case of any services performed by Chevron, either the performance of the services again or the payment of the cost of having the services performed again.
(c) In no event shall Chevron's total liability (or the total liability of any of the entities in the Chevron Group) to you for all damages, losses, and causes of action (whether in contract, tort (including, but not limited to, negligence) or otherwise) exceed the amount paid by you to Chevron, if any, for using the Application, the Account, and/or the Caltex Rewards Program.
12. Trade marks
All trade marks, service marks, logos and trade names, whether registered or unregistered, are proprietary to Chevron or to other companies where so indicated. You may not reproduce, download or otherwise use any such trademarks, service marks, logos or trade names without the prior written consent of the appropriate owner thereof.
13. Access to Linked Sites
You may be able to access Linked Sites. Linked Sites are not reviewed, controlled, or examined by any of the entities in the Chevron Group in any way and none of the entities in the Chevron Group is responsible for the content, availability, advertising, products or other materials of any such Linked Sites, or any additional links contained therein. These links do not imply Chevron Group’s endorsement of, association, partnership or any other relationship with the Linked Sites and/or their operators. It is your sole responsibility to comply with the terms of service of the Linked Sites as well as with any other obligation under applicable laws related to the use of such Linked Sites and any content contained thereon. In no event shall any of the entities in the Chevron Group be liable, directly or indirectly, to anyone for any loss or damage arising from or occasioned by the creation or use of the Linked Sites or the information or material accessed through these Linked Sites. Any concerns should be directed to the relevant Linked Site’s administrator or webmaster. Chevron reserves the right, to add, change, decline or remove, without notice, any link to any of the Linked Sites from the Application and/or introduce different links to different Members.
14. Notice
Any prior notice we are required to provide to you under these Terms is subject to the following conditions:
(a) We will endeavour to provide you with at least 30 days' notice where prior notice is required under these Terms. Any action notified to you will be deemed to take effect from the later of:
(i) the date specified on the notice; or
(ii) 30 days from the date notice is provided.
(b) Where we are unable to provide you with 30 days' notice, we will provide you with as much prior notice as we are reasonably able to.
(c) We will provide notice to you by electronic communication. The types of electronic communication we will use may include text message, email, via the Application, and/or via the Chevron website.
(d) Any notice given to you via email or text message will be through the email address and/or mobile number you have provided to Chevron in accordance with clause 5.2.
(e) You agree that by turning off notifications in the Application or from the website or restricting your ability to receive electronic communication from us in any other way, you may not receive important information about your Membership. In these circumstances, you are acknowledge that you may not receive important notices about changes to these Terms.
(f) Notwithstanding any other provisions in these Terms, Chevron is not liable for any failure to provide you with any notice required for reasons outside of its control.
15. Collection, Use and Disclosure of Personal Data
The collection, use and disclosure of the Members’ personal data will be in accordance with the Chevron Privacy Statements. By using their Caltex Rewards Card or by logging into their Account to participate in the Caltex Rewards Program, the Member shall be deemed to have read and understood the terms of the Chevron Privacy Statements. This is the entire agreement between you and Chevron relating to the subject matter herein and shall not be modified except in accordance with these Terms.
16.2 Variation
(a) Chevron reserves the right to modify, update, replace or change any or all of these Terms or its policies relating to the Caltex Rewards Program at any time and from time to time, with prior notice. Chevron will make reasonable efforts to highlight material updates or changes to these Terms when providing notice to you of such changes. It is your responsibility to review these Terms, including if and when they are amended, and contact Chevron if you have a complaint or query in relation to them. Your continued participation in the Caltex Rewards Program will be deemed to constitute your agreement to and acceptance of such changes. If you do not agree to any update or change, you must immediately cease participating in the Caltex Rewards Program.
(b) Further, Chevron may at any time and from time to time introduce updates, enhancements, changes or new features to the Caltex Rewards Program. Any such changes or new features introduced will be subject to these Terms.
16.3 Assignment
(a) No rights of any Member against Chevron under these Terms may be assigned or otherwise disposed of.
(b) Chevron may at any time assign or transfer all or any part of its rights and/or obligations under these Terms relating to any Account, Caltex Rewards Cards and/or the Caltex Rewards Program without the prior consent of any Member.
16.4 Severability
If any provision of these Terms shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
16.5 Remedies
No failure to exercise or delay in exercising any right, power or remedy under these Terms operates as a waiver. A single or partial exercise or waiver of the exercise of any right, power or remedy does not preclude any other or further exercise of that or any other right, power or remedy. A waiver is not valid or binding on the party granting that waiver unless made in writing.
16.6 Third Party Rights
Save as expressly stated otherwise, no third party shall have any right to enforce any provision of these Terms.
16.7 Governing Law and Dispute Resolution
(a) These Terms shall be governed by and construed in accordance with the laws of Queensland, Australia without giving effect to any principles of conflicts of law.
(b) By participating in the Caltex Rewards Program, you submit to the non-exclusive jurisdiction of the Queensland courts.
