Star Fuels Marketing Limited and its parent and other affiliated or related companies (“Company” or “we”) are committed to protecting your privacy. This statement explains the steps we take to collect, use and protect personal data of users of the CaltexGO mobile application (“Application”) and members of the Caltex Rewards Programme ("Programme") who are issued with digital loyalty cards on the Application and linked to your Account, or a physical card or an Account on Company’s website or an Account applied at payment terminals device at any of the Stations (collectively “Cards”). It describes what categories of personal data we collect, the purposes for which we use those data, your choices regarding use of personal data about you, our security measures, how you can review and correct data about you and your rights relating to personal data. By accessing and/or using the Application and/or signing up to participate in the Programme, you acknowledge that we will collect, use and disclose your personal data in accordance with the practices described in this privacy statement. This privacy statement does not apply to websites, applications and/or other services that display or link to a different privacy statement or policy (such statements or policies may be made available separately by the Company).

As used throughout this Privacy Statement, the term "Company" and such terms as "legal entity," "the corporation," "our," "we" and "us" may refer to Star Fuels Marketing Limited, or one or more or all of Star Fuels Marketing Limited's related corporations and/or affiliates. All of these terms are used for convenience only and are not intended as a precise designation of any of the separate companies, each of which manages its own affairs.

Data Collection

Data collected directly from data subjects. In order to access and/or use the Application or Programme, we may ask you for personal data to register your user account in the Application, Company’s website or records at the payment terminals device at any of the Stations (“Account”) to provide a service offered through the Application and/or the Programme or to carry out a transaction you request or undertake any other actions for the purposes as described under this privacy statement or in other documents that we may notify you separately. The personal data and other information that we collect may include:

If you decide to use the Application and/or to become a member of the Programme, we may ask you to provide further personal data necessary for the performance of such services and/or authentication or a transaction that you request (including the earning and/or redemption of the loyalty points awarded under the Programme ("Points") and/or the proceeding of transaction in the Application, website, or payment terminal at station) required in connection with the Application and/or Programme, such as type of vehicle, driver pattern, and birth month and birth year.

You are not required to provide this information. However, if you choose not to, certain functionality within the Application and Programme may not be available and we may not be able to provide you the requested service or complete your transaction (including the processing the earning and/or redemption of the Points).

Data collected by automated means. We collect certain data about all users of the Application and members of the Programme (as appropriate/applicable), including:

(iv) if they register any loyalty cards (including the Cards) or partner card(s) – data relating to the card transactions including location of the transaction, date and time of transaction, earning of loyalty or rewards points, redemptions of loyalty or rewards points, balance enquiries, the redemptions that they have chosen, the amount of loyalty points they have earned and/or redeemed, the frequency and time of redemption of their points, and the delivery method used to provide them with their redemption (if any).

Through your Account, we may connect such information with your identity and email address to determine your potential interests in our products and services. Apart from information which may be linked to a specific user, we may also collect data on an aggregated or anonymized basis that does not directly identify any specific user.

We use the data and information collected to, amongst other legitimate business purposes, improve our security measures, to better understand how users access and use the Account and the Programme and how it can be improved to better meet your needs, as well as to gauge interest in our products and services.

Customer service and feedback. We may use information about you and/or collected from you to respond to your customer service requests and feedback, or take other actions to address your inquiries, or to post your comments or feedback on any social media maintained by us.

Application improvement and troubleshooting. We may use data about you to improve or enhance the Application (including our security measures) and related products or services the Programme, or to make the Application or Account easier to use by eliminating the need for you to repeatedly enter the same information, or by customizing the Application viewed through your Account to your particular preference or interests. We may also use personal data and other information for the purposes of troubleshooting, functionality testing and addressing issues regarding the Application and/or the Programme and their functionalities.

Marketing and Promotional Communications. With your permission, we may use personal data to inform you of products, services or promotions available from Company. This may involve combining your personal data with other information such as the transactions you have made through the Application and/or under the Programme. Communications may be done by email, SMS and/or through your Account or through the Application (such as in-app messaging services). When collecting information that might be used to contact you about our promotions, products and services, we give you the opportunity to opt-out from receiving such communications. Moreover, each email or SMS communication we send includes an unsubscribe link allowing you to stop delivery of that type of communication. If you elect to unsubscribe, we will remove you from the relevant list within 10 business days.

Except as described below, personal data that you provide to Company via the Application, your Account or other means will not be shared outside of Company and its affiliates and related corporations without your consent.

Disclosure to service providers. Company contracts with other companies, vendors and service providers to provide services on our behalf, such as social media services, programming (for apps or websites who use Company’s APIs or whose APIs Company uses), marketing and promotions, data processing, sending out information and communications, processing credit card and other types of payment transactions, processing loyalty or rewards programme transactions (including the transactions, membership and participation under the Programme), and analyzing the Application. We provide these companies with only those elements of personal data they need to deliver those services. These companies and their employees are prohibited from using those personal data for any other purposes.

Company is committed to protecting the security of personal data. While no security measure can guarantee against compromise, loss or misuse (given the transmission of data over the Internet or any public network), we use a variety of security technologies and procedures to help protect data from unauthorized access, use, or disclosure. Where Company discloses or provides any data to any contractor, vendor or service provider, we require that each such party maintains appropriate administrative, technical and physical security measures to protect your personal data from destruction, loss, and unauthorized access. For example, we store (or ensure that our service providers store) the personal data you provide on computer systems with limited access that are located in facilities to which access is limited. When you move around a site to which you have logged in, or from one site to another that uses the same login mechanism, we verify your identity by means of an encrypted cookie placed on your machine. For sites and applications to which you log in, it is your responsibility to ensure the security of your passwords (including the password to your device) and to not reveal this information to others. If you are sharing a device with anyone, you should always log out before leaving a website or application so that subsequent users will not be able to access your data.

Retention and Review of Personal Data

During the period that your Account is active, Company will retain your personal data and other information collected, unless you expressly request us to delete the information. Company may retain the information after your Account is deactivated or deleted in the following circumstances (subject to applicable law):

(i) if we are required to retain such information by applicable law or regulation, or pursuant to any requirement of any government authority having jurisdiction over Company;

To the extent required by law, we provide users with (i) reasonable access to the personal information they provide through the Application or in their Account, (ii) the ability to review, correct and delete such personal information, (3) exercise your right to data portability, (4) object to the collection, use or disclosure your personal data and (5) request that we restrict the use of your personal data during a period that we are reviewing your objection to the use of your personal data (6) request that we delete or destruct your personal information when it is no longer necessary to retain your personal data. International Transfers of Personal Data

Personal data collected through the Application or your Account may be stored and processed in Thailand or the United States or any other country in which Company or its affiliates or related corporations or (in the case where we engage a service provider to perform certain services) its service providers maintain facilities, including countries which may not have data protection laws similar to the laws in the country from which you initially provided the information. When we transfer your information to other countries, we will protect that information to the extent required by law. By choosing to use the Application, to participate in the Programme and/or to provide data through the Application or through your Account or through other means, you acknowledge that we may transfer your information outside of your country on a lawful basis such as for the purpose of performing our obligations under the contract to which you are a party or performing your request or for the purpose of performing our duty under a contract with a third party for your benefits or for the purpose of compliance with and, if the law requires that we seek your consent, we will do so before transferring your personal data to a country outside Thailand.

บริษัทอาจปรับปรุงนโยบายความเป็นส่วนตัวฉบับนี้เป็นครั้งคราว ในกรณีดังกล่าว เราจะแก้ไข “วันที่ปรับปรุง” ที่ระบุอยู่ในส่วนท้ายของนโยบายความเป็นส่วนตัว ท่านควรตรวจสอบหน้าดังกล่าวเป็นระยะ ๆ เพื่อรับทราบข้อกำหนดความเป็นส่วนตัวฉบับแก้ไขล่าสุด โดยการใช้แอปพลิเคชัน การใช้บัญชีของท่าน และ/หรือการเข้าร่วมระบบสะสมคะแนนอย่างต่อเนื่องหลังจากการเผยแพร่การแก้ไขนโยบายความเป็นส่วนตัวจะถือว่าท่านได้ให้ความตกลงต่อการแก้ไขดังกล่าว
