1. Application of these Terms
These are the terms and conditions ("Terms") of the Caltex Rewards Programme. By participating in the Caltex Rewards Programme, you agree to be bound by these Terms and all terms incorporated by reference herein, without any limitation or qualification.
In these Terms, the following terms shall have the meanings as set forth below, save where the context otherwise requires:
(a) "Account" means a user account on the Application, Chevron’s website or records;
(b) "Application" means the CaltexGO mobile application;
(c) "Caltex Rewards Card" means the card which reflects a Member's membership in the Caltex Rewards Programme, which may either be a digital card issued on the Application and linked to your Account, member’s registered mobile number on the program, or an Account on Chevron’s website;
(d) "Caltex Rewards Points" means the loyalty points issued to Members through the Caltex Rewards Programme;
(e) "Caltex Rewards Programme" means the loyalty rewards programme owned and managed by Chevron, the terms and conditions of which are set out in these Terms;
(f) "Chevron" or "we" (including its variations "our" and "us") means Chevron Philippines Inc.
(g) "Chevron Group" means collectively Chevron and its parent and other affiliated or related companies;
(h) "Linked Sites" means the third-party websites that may be linked via the Application in connection with the Caltex Rewards Programme;
(i) "Member" or "you" means a person who has been approved by Chevron to participate in the Caltex Rewards Programme;
(j) “Partner Programme” means a loyalty programme managed by a third party that Chevron has partnered with as part of the Caltex Rewards Programme;
(k) "Station" means any Caltex service station situated in the Territory; and
(l) "Territory" means Philippines.
3. Programme Overview
3.1 Introduction of Caltex Rewards Programme
With the aim of facilitating better connections with its customers, Chevron has implemented the Caltex Rewards Programme. The Caltex Rewards Card enables the Members to earn and redeem Caltex Rewards Points, subject to such terms and conditions as may be determined by Chevron from time to time and notified to its customers via Chevron’s rewards catalogue or other means
3.2 Existing Partner Loyalty Programme
Prior to the introduction of the Caltex Rewards Programme, some Members may have had another reward card for fuel purchases at the Stations run by our third-party service provider (“Prior Rewards Card”) and accumulated points (for example Go Rewards or Robinsons Rewards Card) (“Prior Rewards Programme”). Notwithstanding the introduction of the Caltex Rewards Programme, the points accumulated through the Prior Rewards Card will continue to be valid and can be redeemed through the Prior Rewards Programme subject to its terms and conditions as notified by Chevron and the third-party service provider from time to time.
4. Eligibility & Registration
4.1 Eligibility Criteria
Any individual person aged 18 or above may apply to be a Member. However, Chevron reserves the right to determine in its sole discretion the eligibility of any individual as a Member and to reject any application for the Caltex Rewards Programme without having to provide any reason whatsoever to the applicant.
4.2 Registration Process
(a) In order to participate in the Caltex Rewards Programme, you will need to submit an application through Chevron's website or via the Application, as instructed by Chevron from time to time. No application fee or membership fee is payable. Unless you have successfully completed the application process, you will not be able to earn or redeem any Caltex Rewards Points under the Caltex Rewards Programme.
(b) All mandatory fields specified in the application for the Caltex Rewards Programme (including your full name, month and year of birth, mobile number and a valid email address) must be completed and validated for the application to be processed. Chevron may contact you through the email address you have provided regarding the Caltex Rewards Programme, and for other purposes as may be mentioned in these Terms and the Privacy Statement.
5. Membership & Caltex Rewards Cards
5.1 Approval for Membership
(a) Upon approval of your application by Chevron, Chevon may elect in its sole discretion to issue a digital Caltex Rewards Card or no Card but in all cases, your membership in the Caltex Rewards Programme will be reflected in your Account. Upon your membership being reflected in your Account, you may commence participating in the Caltex Rewards Programme through qualifying purchases for the purposes of accumulating the Caltex Rewards Points and redeeming them for rewards, subject always to the terms and conditions prescribed by Chevron in its discretion from time to time.
(b) You acknowledge that your membership in the Caltex Rewards Programme is personal to you, and shall not be transferred to any other person.
5.2 Representations and Warranties by Member
You represent and warrant that all information provided in connection with the registration and participation in the Caltex Rewards Programme is true, accurate and not misleading, and will remain true, accurate and not misleading for as long as you remain as a Member. In the event of any changes to the details or particulars from time to time, you shall update Chevron either through Chevron's website, the following hotline numbers : PLDT: (02) 88677710, Globe: (02) 87937600, PLDT Toll Free: 1-800-1-888-2178, Digitel Toll Free: 1-800-3-888-2178, Press Option 2 ,or via the Mobile Application.
5.3 Rights of Chevron
Chevon may at any time, in its sole discretion, with or without prior notice to the Members, do any or all of the following:
(a) suspend or terminate any Caltex Rewards Card or any membership in the Caltex Rewards Programme, which may result in the forfeiture of the Caltex Rewards Points associated with such Caltex Rewards Card or membership in the Caltex Rewards Programme, without any compensation to the Member;
(b) refuse to renew the membership in the Caltex Rewards Programme;
(c) terminate an existing Caltex Rewards Card and assign a new Caltex Rewards Card with a new card number to the Member; or
(d) introduce, amend, restrict, suspend, terminate or make any changes to any or all of the benefits, services, facilities and privileges in respect of or in connection with the Caltex Rewards Cards and/or the Caltex Rewards Programme.
6. Accumulation and Validity of Caltex Rewards Points
6.1 Methods to Earn Caltex Rewards Points
A Member can earn the Caltex Rewards Points via any of the following methods:
(a) purchase of fuel at any Station;
(b) referral of the Caltex Rewards Programme to a friend (if available to country);
(c) purchase of qualifying goods and services as prescribed by Chevron from time to time and listed on Chevron's website and the Application; or
(d) such other method as Chevron may notify from time to time,
subject to such terms and conditions (including but not limited to minimum spend conditions and verification requirements) as may be determined by Chevron from time to time. Additional Caltex Rewards Points may be issued by Chevron in its sole discretion during special promotions.
(a) In addition to the above, Chevron shall record and credit the Caltex Rewards Points only at the point of sale, subject to Chevron's verification of the validity of your membership in the Caltex Rewards Programme. No Caltex Rewards Points will be awarded for any previous or backdated receipts. A Member may not earn points for transactions more than Php7,000 worth per transaction, 2 transactions within a day and Php 30,000 worth of cumulative transactions per month. Caltex Rewards Points will be awarded based on the customer’s actual spend (Actual spend = Original amount – (discount + pay with points).
(b) In the event that any of the conditions to earn Caltex Rewards Points is not met, Chevron may, in its sole discretion, do any of the following:
(i) delay the recording and crediting of such Caltex Rewards Points in the Member’s Account until all the relevant conditions are met;
(ii) refuse to record and credit such Caltex Rewards Points in the Member’s Account; or
(iii) if the Caltex Rewards Points have already been recorded and credited into the Member’s Account, cancel and deduct such Caltex Rewards Points from such Account.
(c) Any decision made by Chevron under this paragraph 6.2 shall be final and binding.
6.3 Accumulation of Caltex Rewards Points
You can check your accumulated Caltex Rewards Points and your transaction history by logging into your Account on the Application or Chevron’s website. For the avoidance of doubt, Chevron will not be providing periodic updates or physical statement to you regarding your accumulated Caltex Rewards Points.
(a) The Caltex Rewards Points earned in a calendar year will expire with a maximum of three (3) calendar years. The cut off date for points expiry is 31 December (as an example, Caltex Reward Points earned in February 2, 2022 and December 30, 2022 will both expire on 31 December 2024.) Chevron reserves the right to amend the validity period of the Caltex Rewards Points from time to time without any prior notice to the Members, and such amendment shall take place from the date on which it is published on Chevron's website or on the Application (whichever is earlier). Expired Caltex Rewards Points will be automatically forfeited at the absolute discretion of Chevron without compensation to the Member.
(b) The Caltex Rewards Points are automatically void upon termination of the Caltex Rewards Programme, or when you cease to be a Member. Members shall not be entitled to any compensation in respect of any cancellation of Caltex Rewards Points by Chevron pursuant to these Terms.
The Caltex Rewards Points accumulated in your Account cannot be transferred or assigned to any other Member.
7. Redemption of Caltex Rewards Points
7.1 Conditions to Redemption
(a) A Member may only redeem the Caltex Rewards Points after he/she has accumulated sufficient points in his/her Account and is eligible for such redemption, subject to fulfilling any terms and conditions as may be imposed by Chevron from time to time. The Caltex Rewards Points utilised for redemption shall be on a first-in-first-out basis.
(b) In order to redeem the Caltex Rewards Points for fuel or any product at the Station, a Member must present his membership in the Caltex Rewards Programme at the point of purchase. A Member who fails to present his membership at the point of such redemption will not be permitted to redeem the Caltex Rewards Points.
(c) Chevron reserves the right to adjust (whether by way of an increase or a decrease) the Caltex Rewards Points required for redemption without any prior notice to the Members. All redemptions are subject to availability and change, and Chevron reserves the right to cancel, amend, substitute or remove any rewards or the terms of redemption without any prior notice to the Members.
(d) Notwithstanding anything contained herein, the Caltex Rewards Points are not convertible to cash.
7.2 Offsetting Payments
The Members may use their Caltex Rewards Points to offset payments for fuel purchases at any Station, whether partially or fully. The redemption of the Caltex Rewards Points for offsetting payments is subject to the following:
(a) unless permitted in these Terms, any deduction of the Caltex Rewards Points from the Account shall not be refunded to the Member for any reason whatsoever; and
(b) in the event that payment still needs to be made by the Member after offsetting the purchase price against the redeemed Caltex Rewards Points, the Member shall make the necessary payment and shall not dispute the amount payable.
Subject to the relevant terms and conditions prescribed by Chevron from time to time, the Members may use their Caltex Rewards Points to:
(c) convert them into such vouchers as notified by Chevron from time to time;
(d) redeem rewards from the rewards catalogue of the Caltex Rewards Programme, which is published on Chevron's website and/or the Application, provided always that the use of any rewards is subject to the terms and conditions imposed by the relevant merchant offering the reward, any disputes concerning any rewards shall be settled between the Member and the relevant merchant offering the reward, and Chevron shall not in any way be involved in such claims and/or disputes (save where Chevron itself is the merchant supplying the reward);
(e) take part in or contribute to any sustainability initiatives, activities or events which are initiated or organised by the Chevron Group (either on its own or with third parties); and
(f) take part in or contribute to any initiative or programme initiated or organised by the Chevron Group (either on its own or with third parties), as notified from time to time by way of a publication on Chevron's website and/or the Application.
7.4 Conversion of Loyalty Points for points in Partner Programmes
Where Caltex Rewards introduces a programme where Caltex Rewards Points qualify for conversion to loyalty points in our Partner Programmes (or vice versa), the following requirements will apply:
(a) the Member must also be a member of the Partner Programme,;
(b) the conversion rate is to be determined by mutual agreement between Chevron and the relevant Partner from time to time;
(c) the Member must have the requisite number of Caltex Rewards Points or the loyalty points in the Partner Programme (as the case may be) to perform the intended conversion transaction, throughout the entire conversion process until completion, failing which Chevron or the Partner (as the case may be) may decline to proceed with the conversion;
(d) in the event of a mistake or error in the number of Caltex Rewards Points to be deducted for the conversion, Chevron reserves the right to, in its sole discretion, cancel the conversion request or process the conversion and deduct the correct number of Caltex Rewards Points in respect of such conversion transaction;
(e) all conversion requests received by Chevron are final and cannot be cancelled by the Member; and
(f) all successful conversion transactions are final and non-cancellable, and in no event shall Chevron be responsible for any error, delay or failure of the Partner to send its confirmation of the successful conversion request on the Partner Programme or to issue the correct number of loyalty points pursuant to the conversion transaction.
7.5 Choice of programme
Where Caltex Rewards introduces a programme where Members who are also members of certain Partner Programme have an option of choosing whether to earn and redeem their loyalty points for the qualifying purchases through the Caltex Rewards Programme or through the Partner’s Program,
(a) if the Member chooses to earn and redeem their loyalty points through the Caltex Rewards Programme, these Terms will be applicable; and
(b) if the Member chooses to earn and redeem their loyalty points through the Partner’s Programme, the relevant terms and conditions of the Partner Programme will be applicable.
8.1 Changes to the Account
Notwithstanding any other provisions in these Terms, Chevron reserves the right to make any changes to the Member’s Account (including but not limited to crediting or deducting Caltex Rewards Points from the Account, or suspending or terminating the Account) and/or disqualify the Member from participating in any contest, lucky draw, program, activity or event organised by Chevron (whether solely or jointly with any other partners or collaborators) without prior notice to the Member, upon the occurrence of any of the following circumstances:
(a) wrongful crediting or deduction of the Caltex Rewards Points arising from:
(i) system glitches, malfunction, failure or disruption with respect to the Account and/or the Application;
(ii) human error;
(iii) dishonest or fraudulent transactions, acts or omissions conducted by the Member or with respect to the Account; or
(iv) operational mistakes or changes;
(b) inaccurate, false, misleading or illegible information supplied by the Member; or
(c) changes in the terms and conditions of such contest, lucky draw, programme, activity or event.
8.2 Representations and Warranties by Member
You represent and warrant that:
(a) you will not create more than one Account for the Application;
(b) you will not share your password or allow any other person to access your Account, or otherwise do anything that may or will violate the security of your Account;
(c) you will keep all information provided by you through the Application up to date and accurate;
(d) you will not transfer your Account to any other person without prior permission from Chevron; and
(e) you are responsible for the use of your Account and all activities that are carried out through the Account, whether authorised or unauthorised and must immediately notify Chevron if you become aware of any unauthorised use of or access to your Account.
9.1 Termination by Chevron
(a) Chevron may in its sole discretion, with reasonable prior notice to the Members, suspend or terminate the Caltex Rewards Programme. The Members shall not be entitled to any compensation for any such suspension or termination.
(b) Chevron may terminate or suspend the Member's Account and membership in the Caltex Rewards Programme with immediate effect if any one or more of the following shall occur:
(i) the Member no longer holds a valid Account or Caltex Rewards Card (as the case may be);
(ii) the Member's Account does not have any activity for a continuous period of 36 months;
(iii) the Member commits or is reasonably suspected of committing any fraud or misrepresents or is reasonably suspected of misrepresenting any information supplied or to be supplied by the Member; or
(iv) the Member commits a material breach of these Terms and such breach is either not capable of being remedied or if it is capable of remedied, the Member fails to remedy it within 30 days from the date of written notice by Chevron requiring such breach to be remedied.
9.2 Termination by Member
A Member may withdraw from the Caltex Rewards Programme at any time by contacting Chevron's customer service centre at PLDT: (02) 88677710, Globe: (02) 87937600, PLDT Toll Free: 1-800-1-888-2178, Digitel Toll Free: 1-800-3-888-2178, Press Option 2 or via the Application.
9.3 Consequences of Termination
Upon termination of the Member's Account or the Caltex Rewards Programme, all Caltex Rewards Points accumulated in the Member's Account shall be forfeited.
10. Liability and Indemnity
10.1 Member's Liability
Each Member assumes all risks and liabilities for loss or damage arising from his or her participation in the Caltex Rewards Programme.
Each Member shall indemnify and hold each of the entities in the Chevron Group and their respective directors, officers, employees, agents and contractors harmless from and against any and all claims, proceedings, loss, damage, costs and expenses (including legal costs on a full indemnity basis) incurred, suffered or sustained by each of the entities in the Chevron Group and their respective directors, officers, employees, agents and contractors directly or indirectly arising from or relating to the Member’s participation in the Caltex Rewards Programme.
(a) To the fullest extent permitted by law, each of the entities in the Chevron Group disclaims any liability whatsoever arising from or relating to the Member’s usage of the Application and/or participation in the Caltex Rewards Programme, howsoever arising, including but not limited to, the redemption and use of the rewards, any breakdown or malfunction in any computer system or equipment, any notice which is misdirected and/or lost in the post, loss of income, profits or goodwill, as well as any other direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties howsoever arising whether in contract, tort, negligence or otherwise.
(b) To the fullest extent permitted by law, none of the entities in the Chevron Group shall be liable for any claim, loss, damage, cost or expense incurred, suffered or sustained by the Member arising from or in connection with:
(i) any failure or refusal by any merchant in accepting the Member's membership in the Caltex Rewards Programme or crediting of the Caltex Rewards Points into the Member's Account;
(ii) any loss of data and records relating to the Member's Account or the Caltex Rewards Programme;
(iii) any loss of or inability to use the stored Caltex Rewards Points in the Member's Account;
(iv) any acts, omissions, negligence or wilful default on the part of the merchant;
(v) any acts, omissions, negligence or wilful default on the part of any of the entities in the Chevron Group and their respective directors, officers, employees, agents or contractors; or
(vi) any failure or inability of the Member to access the Application and/or his or her Account.
(c) For the avoidance of doubt, termination or suspension by Chevron of the Caltex Rewards Programme shall not entitle any Member to any claim or compensation against any of the entities in the Chevron Group for any and all loss or damage suffered or incurred directly or indirectly as a result of such termination or suspension.
11.2 Accumulation of Caltex Rewards Points
The Member agrees that the Caltex Rewards Cards (if issued) are intended to be used as loyalty cards for the accumulation of the Caltex Rewards Points for eligible purchases and that Chevron does not make any representation or warranty with respect to any goods and/or services purchased, whether or not the purchase qualifies for the award of the Caltex Rewards Points. None of the entities in the Chevron Group shall be liable for any claim, loss, damage, injury, death, costs or expenses howsoever incurred, suffered or sustained by the Member as a result of or in connection with the purchase of such goods and/or services. The Member agrees to direct all claims in relation to such goods and/or services to the relevant supplier, manufacturer or such appropriate third party concerned with the supply of such goods and/or services.
11.3 Redemption of Caltex Rewards Points
(a) The Member acknowledges and accepts that the use of the Caltex Rewards Points to offset payments shall constitute a contract for sale between the Member and such merchant. As such, none of the entities in the Chevron Group assumes any liability in respect of any goods and/or services purchased by the Member from the merchant using the Caltex Rewards Points. The Member agrees to direct all claims in relation to such goods and/or services to the relevant merchant or such appropriate third party concerned with the supply of the relevant goods and/or services.
(b) If applicable, none of the entities in the Chevron Group shall be liable for any loss or damage suffered or incurred by the Members directly or indirectly in connection with their participation in the Partner Programme and/or the conversion of Caltex Rewards Points into Partner Points.
(c) To the fullest extent permitted by law, none of the entities in the Chevron Group makes any representations or warranties, express or implied, and disclaims any and all liabilities as to the condition, quality, merchantability or fitness for use or purpose of any goods and/or services provided to the Member upon redemption of the Caltex Rewards Points.
12. Limitation of Liability
To the fullest extent permitted under applicable law, under no circumstances, including, but not limited to, negligence, shall any of the entities in the Chevron Group be liable for any compensatory, punitive, indirect, special or consequential damages that result from the use of, or the inability to use, the Application, the Account, and/or the Caltex Rewards Programme, even if Chevron or a Chevron authorised representative has been advised of the possibility of such damages. Applicable law may not allow the limitation or exclusion of liability or incidental or consequential damages, and so to that extent the above limitation or exclusion may not apply to you. In no event shall Chevron's total liability (or the total liability of any of the entities in the Chevron Group) to you for all damages, losses, and causes of action (whether in contract, tort (including, but not limited to, negligence) or otherwise) exceed the amount paid by you to Chevron, if any, for using the Application, the Account, and/or the Caltex Rewards Programme.
All trademarks, service marks, logos and trade names, whether registered or unregistered, are proprietary to Chevron or to other companies where so indicated. You may not reproduce, download or otherwise use any such trademarks, service marks, logos or trade names without the prior written consent of the appropriate owner thereof.
14. Access to Linked Sites
15. Collection, Use and Disclosure of Personal Data
16.1 Entire Agreement
This is the entire agreement between you and Chevron relating to the subject matter herein and shall not be modified except in writing or in accordance with paragraph 16.2.
(a) Chevron reserves the right to modify, update, replace or change any or all of these Terms or its policies relating to the Caltex Rewards Programme at any time and from time to time, by posting an updated or revised version on Chevron's website or the Application. Any modification, update, replacement or change to the Terms or any policy relating to the Caltex Rewards Programme shall be effective upon posting of the updated or revised version. Although Chevron will endeavour to highlight material updates or changes to these Terms, it is your responsibility to review these Terms regularly to ensure you are aware of the most recent terms as they will be binding on you and your participation in the Caltex Rewards Programme. Your continued participation in the Caltex Rewards Programme will be deemed to constitute your agreement to and acceptance of such changes. If you do not agree to any update or change, you must immediately cease participating in the Caltex Rewards Programme.
(b) Further, Chevron may at any time and from time to time introduce updates, enhancements, changes or new features to the Caltex Rewards Programme. Any such changes or new features introduced will be subject to these Terms.
(a) No rights of any Member against Chevron under these Terms may be assigned or otherwise disposed of.
(b) Chevron may at any time assign or transfer all or any part of its rights and/or obligations under these Terms relating to any Account, Caltex Rewards Cards and/or the Caltex Rewards Programme without the prior consent of any Member.
If any provision of these Terms shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
No failure to exercise or delay in exercising any right, power or remedy under these Terms operates as a waiver. A single or partial exercise or waiver of the exercise of any right, power or remedy does not preclude any other or further exercise of that or any other right, power or remedy. A waiver is not valid or binding on the party granting that waiver unless made in writing.
16.6 Third Party Rights
Save as expressly stated otherwise, no third party shall have any right to enforce any provision of these Terms.
16.7 Governing Law and Dispute Resolution
(a) These Terms shall be governed by and construed in accordance with the laws of Philippines, without giving effect to any principles of conflicts of law.
(b) By participating in the Caltex Rewards Programme, you submit to the non-exclusive jurisdiction of the Philippine courts.
17. Usage of SavePlus with Caltex Rewards
Starting December 2023, SavePlus can be used in conjuntion with Caltex Rewards. Amount net of discount from SavePlus will earn Caltex Rewards points based on Caltex Rewards points conversion.
17. 1 The SavePlus Card
The SavePlus Card enables the Cardholder to purchase Products from any Authorized Retailer and to avail of the preferential rate/discount based on agreement with CARDHOLDER GROUP. CHEVRON, shall not, however, in any way be bound to ensure the availability or provision of the Products or be liable in the event of such non-availability or non-provision thereof.
The SavePlus Card issued by CHEVRON is the sole property of CHEVRON. It is not transferable and will be honored by CHEVRON Authorized Retailers only when properly presented by the authorized CARDHOLDER in good standing. The CARDHOLDER is in good standing if his privilege to use the SavePlus Card is not suspended or terminated and has not expired.
Issuance of additional SavePlus Cards other than those previously issued shall require a request from CARDHOLDER GROUP to CHEVRON and issuance thereof shall be subject to sole discretion of CHEVRON.
17. 2. Expiry and Renewal
Unless earlier terminated, voluntarily cancelled, or returned by the COMPANY, the SavePlus Cards shall be valid for three years after the first transaction. Renewal of cards will be a case-to-case basis, depending on the agreement between CHEVRON and the COMPANY that provided the card to the CARDHOLDER.
17. 3 Term of Agreement and Renewal
All SavePlus Cards shall be deemed cancelled effective upon termination or expiration of the agreement between CARDHOLDER GROUP and CHEVRON.
The CARDHOLDER agrees to hold CHEVRON free and harmless from any claim for damages arising from such termination unless CHEVRON is the one which violates said Agreement.
17. 4 Discount
CHEVRON agrees to grant the CARDHOLDER a fixed Peso per liter discount at Point of Sale based on agreement with CARDHOLDER GROUP. Discount is subject to review by CHEVRON and any changes will be communicated to the COMPANY before application.
The discount given above is subject to all the following terms and conditions:
(a) Discount is valid for a maximum daily and monthly limit based on agreement with CARDHOLDER GROUP.
(b) Transactions cannot be paid with StarCard, StarCash and local PO;
(c) Discount is valid at all card-accepting Caltex stations. Except at the Caltex stations located in all branches of Landers Superstore;
17. 5 Company Liability
Neither the CARDHOLDER GROUP nor CHEVRON shall be liable to the CARDHOLDER for the use of the SavePlus Card, in the absence of breach of their respective obligations to the CARDHOLDER.
17. 6 Authorized Retailers
CHEVRON has contracted with its Authorized Retailers to honor the SavePlus Card for purchase of CHEVRON Products. CHEVRON shall not be responsible to the CARDHOLDER, if for any reason, the SavePlus Card is not honored. In the event that the SavePlus Card is not honored by Chevron’s Authorized Retailers due to circumstances beyond the control of CHEVRON, CARDHOLDER may contact the Customer Service, Monday to Friday from 6:00 AM to 7:00 PM and on Saturday from 8:00 AM to 3:00 PM to assist the CARDHOLDER to resolve issues arising from the use of the SavePlus Card.
The CARDHOLDER further agrees to not make a claim against Chevron if SavePlus Card is not honored due to circumstances beyond the control of Chevron.
Authorized Retailer shall check the physical features and condition of the SavePlus Card to determine its authenticity according to its format, and its validity and acceptability by checking the card number and the Logo which appear on the card.
17. 7 Suspension or Termination of Card Privileges
CHEVRON reserves the right to suspend, cancel or terminate the use of the SavePlus Card or withdraw the privileges of the CARDHOLDER for any cause with prior notice to the COMPANY.
In the event of the withdrawal of the privilege to use the SavePlus Card for whatever reason, including but not limited to the expiration of the SavePlus Card, suspension or termination of the privileges of the CARDHOLDER, or the CARDHOLDER’s failure to comply with any of the Terms and Conditions of this Agreement, his death (however evidenced), illiquidity of the COMPANY:
(a) The SavePlus Card(s) shall automatically be blocked, and all privileges granted to the CARDHOLDER suspended or terminated.
(b) The CARDHOLDER and CARDHOLDER GROUP agree to indemnify and hold CHEVRON free and harmless from any claims or actions for damages arising from such suspension, cancellation, termination, withdrawal or confiscation of the SavePlus Card and its privileges or this Agreement.
Continued use of the SavePlus Card despite such suspension, cancellation or termination shall be considered fraudulent.
The CARDHOLDER GROUP shall take all reasonable actions necessary to retrieve the SavePlus Cards which have been cancelled. Such SavePlus Cards shall be returned to CALTEX destroyed or cut in half.
17. 8 Limitation of Liability
In the event of any controversy or action arising from this Agreement or any incident thereto which the CARDHOLDER / CARDHOLDER GROUP may file against CHEVRON, the liability of CHEVRON shall not exceed the damages actually proved to have been suffered by the CARDHOLDER / CARDHOLDER GROUP.
