Caltex StarCash Card Conditions of Use
Each Caltex StarCash Gift Card (a Card) is issued by and remains the property of Chevron Australia Downstream Fuels Pty Ltd ABN 34 009 644 151 (Chevron).
These terms and conditions apply to any use of a Card by any person (Customer). A separate contract is created between you as the Customer and Chevron on these terms and conditions for each Card you purchase.
- Acceptance of Conditions of Us
By using a Card, the Customer agrees to be bound by these terms and conditions, as amended or replaced from time to time. Any new or amended terms and conditions will be available on the Caltex website: https://www.caltex.com/au/starcash. - Using StarCash
The Card may only be used at participating Caltex stations in Australia which have Card payment facilities operational and online at the time of purchase. The Card can be used to purchase, or part pay for, selected goods or services available at participating stations. The Card cannot be used to purchase any further Card or Cards, gift cards, pre-paid or post-paid phone or internet vouchers, mobile phones and accessories, lottery tickets, and cannot be used for payment of fuel card, credit or retailer accounts. If the Card has a PIN code, the Customer must enter the PIN at the time of purchase.
A list of participating Caltex stations has been included below. Cards will not be accepted at Caltex unmanned locations or depots.
- Purchase Limit
There is no minimum purchase value when the Card is used. If only part of the value stored on the Card is used, the rest of the value remains stored on the Card to be used at a later time (subject to expiry of the Card). If the value of any purchase(s) by the Customer is greater than the balance stored on the Card, the Customer will be liable to pay the difference in value using another accepted payment method.
To check the balance on a Card, visit a participating Caltex station.
The Card cannot be reloaded and is not redeemable for cash. No cash out facilities are available with the Card.
- Expiry
The Card will be valid for 36 months from the date of issue. A Card cannot be used after the expiry date. Any balance remaining on the Card at expiry will not be available for use and will not be refunded or credited by Chevron. The expiry date will be recorded on the Card at the time of purchase.
Chevron may from time-to-time issue promotional Cards in conjunction with purchases. Promotional Cards may have earlier expiry dates than purchased Cards.
- Customer Responsibility
The Customer is responsible for the Card, and is liable for all transactions made using the Card. The Customer should treat the Card like cash. Defaced, damaged, altered, lost or stolen Cards will not generally be replaced, refunded or redeemed. The Customer must not re-sell a Card or attempt to do so, except with Chevron’s prior written consent and subject to any conditions that Chevron may impose. The Customer must ensure all details on any receipt are correct. Any dispute regarding receipt details or supply of goods and services to the Customer is between the Customer and the relevant Caltex station where the Card was purchased or used. - Defective Cards
If a Card is defective, the Customer may be entitled to a replacement Card or a refund for the amount that was paid for the Card in accordance with the Australian Consumer Law. If Chevron chooses to replace any unused value stored on defective Cards, the replacement Card will have the same unused value as the last balance shown by Chevron’s records as remaining on the original Card, unless the Customer can demonstrate this is incorrect. Replacement Cards will be issued by the Chevron customer service team and will have the same expiry date as the original Card. - Limitation of Liability
To the extent permitted under applicable law, including the Australian Consumer Law, under no circumstances, including, but not limited to, negligence, shall Chevron be liable for any direct and indirect loss, damage or expense – irrespective of the manner in which it occurs – which may be suffered by the use of the Card by the Customer or any other person and/or loss or theft of the Card and/or damage to a card and/or any Caltex station refusing to supply goods or services to the Customer or refusing to accept the Card; and/or inability of any Caltex station to accept the Card due to technical issues including but not limited to unavailability of suitable Card payment facilities.
Where any applicable law (including the Australian Consumer Law) implies any warranties, guarantees or conditions or imposes obligations upon Chevron which cannot be excluded, restricted or modified except to a limited extent ("Non-Excludable Guarantees"), these terms and conditions must be read subject to those statutory provisions and Non-Excludable Guarantees. The above limitation of liability will not apply to the extent those Non-Excludable Guarantees apply and (in that case) Chevron's liability for breach of those Non-Excludable Guarantees only will instead be limited at its option to:
- (i) in the case of any goods supplied by Chevron, either replacement of the goods or supply of equivalent goods, the repair of the goods, payment of the cost of replacing the goods or acquiring equivalent goods or payment of the cost of having the goods repaired; or
- (ii) in the case of any services performed by Chevron, either the performance of the services again or the payment of the cost of having the services performed again.
