These Terms of Use apply only to the website at http://www.caltex.com.hk ("Site"). This Site is owned and operated by Bangchak Hong Kong Limited (the “Operator”, “our”, “we”, and “us”) and should not be confused with any other website whether or not the words the Operator and/or Caltex appear as part of the domain name or branding. You are advised to check each page you visit on or from this Site to determine whether you have moved onto a third party site.
You are prohibited from violating, or attempting to violate, the security of this Site. Any such violations may result in criminal and/or civil penalties against you. We will investigate any alleged or suspected violations and if a criminal violation is suspected, we will cooperate with law enforcement agencies in their investigations. Violations of the security of the Site include without limitation;
i. logging into or attempting to log into a server or account that you are not authorized to access;
ii. accessing data or taking any action to obtain data, information or services not intended for you or your use;
iii. probing, scanning or testing the vulnerability of any system or network, or attempting to do so;
iv. tampering, hacking, modifying or otherwise corrupting or breaching security or authentication measures;
v. transmitting material that contains viruses, Trojan horses, worms, time bombs, cancelbots, malware, corrupted files or other computer programming routines or engines or engage in conduct that could damage, disrupt or otherwise impair or interfere with a computer's functionality or the operation of the Site; and
vi. interfering with service to, or engaging in any denial of service attack of, the Site, any user, host or network including, without limitation by means of overburdening or "flooding," any computer system.
In using this Site, you must not:
i. post, send or otherwise transmit to or through the Site any unlawful, infringing, harmful, harassing, defamatory, threatening, vulgar, sexually explicit, racist, violent, immoral, religiously offensive, hateful or otherwise objectionable material of any kind, any material that exploits children or is invasive of or in breach of another person's privacy or other rights or any material that the Operator in its sole discretion does not wish posted or transmitted on the Site;

v. engage in deceptive online marketing;
vi. violate any applicable laws or regulations; or
vii. assist or permit any persons in engaging in any of the activities described above.

All content included on this Site, such as text, graphics, logos, buttons, icons, images, video clips, audio clips and software, is the property of the Operator, its licensors, content suppliers or vendors (as the case may be) and is protected by the laws of the country applicable in each specific context and international copyright laws. The compilation, (collection, arrangement and assembly) of all content on this Site is the exclusive property of the Operator, its licensors, content suppliers or vendors (as the case may be) and is protected by the laws of the country applicable in each specific context and international copyright laws. All design rights, databases and compilation and other intellectual property rights, in each case whether registered or unregistered, and related goodwill are proprietary to the Operator, its licensors, content suppliers or vendors (as the case may be).
All software used or made available on this Site is the property of the Operator or its licensors or software suppliers and is protected by the laws of the country applicable in each specific context and international copyright laws. In the event that you are permitted by Operator to download and you download software from the Site, the software, including any files, images incorporated in or generated by the software, and data accompanying the software (collectively, the "Software") are licensed to you by the Operator subject to any terms of use accompanying the Software. The Operator, its licensors and software suppliers (as the case may be) do not transfer title to the Software to you. You may own the medium on which the Software is recorded, but the Operator, its licensors and software suppliers (as the case may be) retains full and complete title to the Software, and all intellectual property rights therein. You may not redistribute, sell, modify, adapt, decompile, reverse engineer, disassemble or otherwise reduce the Software to a human-perceivable form, except to the extent permitted by applicable law and on giving the Operator prior written notice of such activities.
The ‘Caltex’ name, trademarks, service marks, logos and trade names used in connection with this Site are owned by Chevron Brands International LLC and/or its affiliates (“Chevron Brands”) and are used by the Operator under a trademark license agreement. The Operator is a licensee of Chevron Brands and is not an affiliate, subsidiary, agent or representative of Chevron Brands or any of its affiliates (collectively, the “Chevron Brand Owners”). The Chevron Brand Owners are not responsible for and have no liability in relation to the operation, management or administration of this Site and assume no responsibility or liability to you in connection therewith.
All trademarks, service marks, logos and trade names, whether registered or unregistered, are proprietary to the Chevron Brand Owners or to other companies where so indicated. You may not reproduce, or otherwise use any such trademarks, service marks, logos or trade names without the prior written consent of the appropriate owner thereof.

These Terms of Use shall be governed by and construed in accordance with the laws of Hong Kong, without giving effect to any principles of conflicts of law. By using this Site you submit to the non-exclusive jurisdiction of the Hong Kong courts. If any provision of these Terms of Use shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any remaining provisions. This is the entire agreement between the parties relating to the subject matter herein and shall not be modified except in writing.
Save in respect of the rights of the Chevron Brand Owners under Section 6 of these Terms of Use, no third party shall have any right under the Contracts (Rights of Third Parties) Act to enforce any provision of these Terms of Use other than a permitted assignee or transferee.
The Operator may sub-contract, delegate or outsource any of its obligations or functions under these Terms of Use or in connection with this Site to any third party without the prior consent of or notice to any user, provided that the Operator shall remain responsible for the performance of such obligations.
The Operator may revise these Terms of Use at any time without notice. Although the Operator will endeavor to highlight any changes to these Terms of Use, you should revisit this Site periodically to make sure you are aware of the most recent terms, because they will be binding on you. Your use of the Site after such changes constitutes your agreement to such changes.
