Terms & Conditions

1.     The Caltex Car Wash Loyalty Program (“Promotion”) is operated by Chevron Australia Downstream Fuels Pty Ltd (ABN 34 009 644 151) of 365 MacArthur Avenue, Hamilton QLD 4007 (“Promoter”).

2.     These terms and conditions contain instructions on how to claim and the reward(s) that form part of the Promotion (“Terms and Conditions"). Your participation in this Promotion is deemed acceptance of these Terms and Conditions. This Promotion is not valid in conjunction with any other offer, discount, privilege or promotion unless expressly specified otherwise by the Promoter. 

3.     The Promotion is only open to Australian residents that hold a valid driver’s licence (including learner’s licence) in an Australian State or Territory. The Promoter’s staff member will check a participant’s driver’s licence to verify their eligibility to participate in the promotion. 

4.     The Promoter reserves the right, at any time, to verify the validity of claims and claimant’s (including a claimant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual from the Promotion who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the claim process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved. 

5.     The Promoter will distribute “Caltex Car Wash Loyalty Cards” (“Loyalty Card”), at no cost, to customers at Participating Stations (defined below) as part of this Promotion. 

6.     A “Participating Station” is any Caltex petrol station in Australia with a car wash function in operation and distributes Loyalty Cards to customers. 

7.     Subject to meeting the claim requirements in clause 8, individuals who participate in the Promotion will be entitled to receive a free “Deluxe Car Wash” at one of the Participating Stations. 

8.     To claim, individuals must complete the following steps: 

• Collect a Loyalty Card from a member of staff at a Participating Station; 
• Have their Loyalty Card stamped after you pay for a Caltex car wash at a Participating Station (“Car Wash”). It is the individual’s responsibility to ensure they provide their Loyalty Card to a staff member to stamp at the time of purchase of the Car Wash. Any request for stamping of the Loyalty Card for a previous Car Wash purchase not presented at the time of purchase will not be honoured; and 
• After purchasing nine (9) Car Washes and presenting a completed stamped Loyalty Card to a member of staff, the individual will be entitled to receive a “Deluxe Car Wash” free at a Participating Station. Loyalty Cards must be surrendered at the time of redemption of the Deluxe Car Wash. 

9.     Multiple claims are permitted subject to the following: (a) only one (1) stamp permitted per Car Wash purchased; (b) only one (1) claim permitted for every nine (9) Car Washes purchased; and (c) each claim must be submitted separately and in accordance with the claim requirements in clause 8. Unrecognised or copied Loyalty Cards will be deemed invalid and determined at the Promoter’s sole discretion.  

10.     The Promoter’s decision is final and no correspondence will be entered into.  

11.     Any ancillary costs associated with redeeming the Loyalty Card are entirely at the expense of the claimant. Redemption of the reward under the Loyalty Card is subject to any terms and conditions specified on the Loyalty Card.   

12.     The Promoter will not be responsible for any lost or stolen Loyalty Cards. 

13.     Rewards, or any unused portion of a reward, are not transferable or exchangeable and cannot be taken as cash. 

14.     If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any claimant; or (b) to modify, suspend, terminate or cancel the Promotion, as appropriate. 

15.     This Promotion continues until terminated by the Promoter. 

16.     The Promoter may terminate this Promotion at any time at its sole discretion by displaying material notifying individuals when the Promotion ends and any terms and conditions for making any outstanding claims.  

17.     These Terms and Conditions and the terms and conditions specified on the Loyalty Card constitute the entire terms of this Promotion. 

18.     To the maximum extent permitted under applicable law, including the Australian Consumer Law, the Promoter will not be liable for, and excludes all liability for, any direct or indirect loss, damage or expense (including if due to negligence) arising in connection with this Promotion. 

19.     The Terms and Conditions of the Promotion may be amended or replaced (or the Promotion suspended or cancelled) by the Promoter at any time at its discretion.
