Terms and Conditions

1. Information on how to enter, the prizes and gifts form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. 

2. Entry is only open to Australian residents (excluding ACT, NT and TAS) aged 18 years or over who are Caltex Rewards members. 

3. Employees (and their immediate families) of the Promoter, Participating Outlets (defined below) and agencies associated with this promotion are ineligible to enter prize draws. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. Due diligence will be conducted to ensure that all winners draw on 10/01/2025 are not in breach of this clause. 

4. Entries into the promotion open on 01/12/2024 at 12am AEDT and close at 11:59pm AEDT on 12/12/2024 (“Promotional Period”). 

5. A “Participating Outlet” is any Caltex station in Australia that advertises the promotion during the Promotional Period. 

6. To be eligible to participate in this promotion, individuals must complete the following steps on any day of the Promotional Period: 

• Visit any Participating Outlet and spend $25 or more on any fuel (with the exception of Day 11 being 11/12/2024), in a single transaction (“Qualifying Transaction”) and scan the Caltex Rewards QR code (within their Caltex Rewards App) at the time of making their Qualifying Transaction.  
•  For clarity, participation on Day 11 (11/12/2024) is limited to spends of $25 or more on Octane 98 only. 

7. Only one (1) entry is permitted per person per day. 

8. By entering this promotion, participants are deemed to have agreed to these Terms and Conditions. If you do not wish to participate in the promotion, you may opt-out by contacting: cccweb@chevron.com. 

9. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved. 

10. Incomplete or indecipherable entries will be deemed invalid. 

11. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant. 

12. The Promotion will be divided into twelve (12) daily activations (each a “Daily Activation”) depending on the day of the Promotional Period. Each Daily Activation will either offer a prize to be awarded by a random draw from all entries received that day (each a “Prize”) or a guaranteed gift to be awarded to each individual to make a Qualifying Transaction that day (each a “Gift”). Subject to the starting and closing time of the Promotional Period, entries into each Daily Activation will open at 12am AEDT and close at 11:59pm AEDT each day.

13. prize draws for Daily Activations where a Prize is available to be won will take place at 3 Amy Close, Wyong NSW 2259 Australia on 10/01/2025 at 1:00pm AEDT and all Prizes will be awarded to the first valid entry drawn. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.  Winners will be notified by email within two (2) business days of the prize draw.  Winner’s details (first initial, surname and postcode) will be published at https://www.caltex.com/au/caltexmas on 14/01/2025. 

14. Prizes that consist of Star Cash vouchers will be sent to winners by 29th January 2025. Where a Prize or a Gift consists of Caltex Rewards Points (“Points”), those Points will be automatically credited to the entrant’s Caltex Rewards Membership within fourteen (14) days of the Prize or Gift (as the case may be) being awarded. 

15. The Promoter’s decision is final and no correspondence will be entered into. 

16. Any ancillary costs associated with redeeming a Star Cash voucher or Points are not included. Any unused balance of a Star Cash voucher or Points will not be awarded as cash. Redemption of a Star Cash voucher or Points is subject to any terms and conditions of the issuer including those specified on the Star Cash voucher or within the Terms of the Caltex Rewards Program available at: https://www.caltex.com/au/motorists/products-and-services/caltex-starcash

17. Subject to the unclaimed prize draw clause (refer to clause 22), if for any reason a winner does not take / redeem a Prize or any Points at/by the time stipulated by the Promoter, then the Prize/Points will be forfeited. 

18. If any Prize and/or Gift is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize and/or Gift with a prize/gift to the equal value and/or specification, subject to any written directions from a regulatory authority. 

19. Entrants consent to the Promoter performing reasonable compliance checks (including sanctions screening) prior to awarding any Prize or Points. The Promoter may (acting reasonably) disqualify any entrant and award Prizes/Points to an alternative winner based on the outcome of these compliance checks. 

20. Total value of all Prizes available to be won is $4,500.  

21. Prizes and/or Points are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified. 

22. A draw for any unclaimed Prizes may take place on 10/02/2025 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified by email within two (2) business days of the draw and their details (first initials, last names and postcodes) will be published at https://www.caltex.com/au/caltexmas on 12/02/2025. 

23. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. 

24. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate. 

25. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion. 

26. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize/Gift claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize/Gift value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use / taking of a Prize and or Gift. 

27. The Promoter may use your personal information directly or through the Promoter's agents or contractors. The Promoter will use your personal information to conduct and manage the promotion. The Promoter may disclose your personal information to the Promoter's related companies, agents and contractors to assist in conducting this promotion, communicating with you/your companions or storing data. This may include disclosures to organisations outside Australia including in places such as the USA, Singapore, and the Philippines. The Promoter’s Privacy Policy (see www.caltex.com/au/privacy-statement-and-personal-data-protection.html) includes information about:

(a)   how to seek access to the personal information the Promoter holds about you and seek correction of the information; and

(b)   how to complain about a privacy breach and how the Promoter will deal with such a complaint
